I will be removing it prior to any warranty work, so i'm not worried about it.
Drilling: YES, you have to drill a small (1/4) hole through the cross member to remount the power steering cup (the bracket is included with the intake)
It's the type of hole i don't think BMW would even notice if you brought it in for work.
If they do, I'll tell them I didn't like the position of the power steering cup
