File for insurance, it's on him anyways so it's his (or his insurance) responsibility to restore it back to it's pre-accident state. You'll have to deal with the insurance to get your fair share (without being dishonest, which just jacks the rate up for all of us).

Structurally, you should be fine. I haven't looked at BMW's but typically there is a foam crush cell right behind the actual reinforcement bar. That takes majority of the low-speed impact; the rebar shouldn't deform at all until the impact becomes more severe. Only way to know is to take it to a shop to find out (or peek under yourself), but I highly doubt there is structural damage.
