I bought my X5 from an Audi dealership in Houston. It was not advertised as CPO on their Web site, but when running the Carfax is clearly showed it had been CPOd by BMW. I called BMW just to make sure, and they confirmed. Then once I purchased the BMW and took it in for service, I had the gentleman in the service department verify it again (I'm a bit paranoid if you can tell) and he wrote down the dates for me when the CPO would expire.
