To the best of my knowledge, they haven't done this, because doing so would make them look like liars being purposefully deceitful to mislead people, (if they did in fact make a 2012 car), and they're not going to go that far and risk ill-will with outspoken niche buyers who would absolutely call them on it.

Agreed! and if they decide at the last minute to make MY2012 models, BMW looks like a hero.
