Is there anyway to tell if you have this software update already? I don't know when this update came out but I'd presume mine has it?

I have not. I can look into that.
I'm out of warranty. So, getting software updates or having it even looked at will probably require a few hundred dollars unless there's some bay area BMW dealer that is rather friendly about such things. Hopefully they don't screw up my car in the process either. Ugh.
