So are they going to use that tool to start the car with the ignition tumbler in the dash?

Exactly. Oh no! How will I prevent them from starting my car that does not have a place for an ignition key. And it would still require some way to bypass the immobiliser. I would rather have them open my door without damage and find nothing loose inside the car than breaking a window and doing the same.

Thieves were using OBDII key recoders to just drive off with cars a few years ago. So while being able to open the door may seem trivial, they could have some other tools on hand...
http://www.1addicts.com/forums/showthread.php?t=712717 Don't remember correctly how, or if this flaw was even fixed. I imagine it involved making the OBDII port harder to access.

This would be the same way as any other device that let's people open cars, my buddy owns a tow truck service and has many tools, all of which have to be registered, if you get pulled over with them without any paperwork, you can get fined or jail time.
