In the end, it came down to money, time in shop, and gas mileage!!

As an SUV-basher, I could not in good conscience buy a car that got 10-12 mpg.

The M5 is a great car. It's just not practical. The E90 is.

That's interesting. Shortly after I ordered my e90, a friend of mine who works as a master mechanic at a local Southern Cal BMW dealership told me he was getting an e39 M5 in pristine condition directly from a seller in Europe. He indicated he would be selling it for around 42K.

Nevermind repair costs, think of the cost in time. Owning an aging M5 as a daily driver is not going to be a carefree experience...there could be times that you need the car and it's just not there for you. I wouldn't expect to encounter any crippling mechanical failures in the E90 during the warranty period.

I would buy the E90 because of the warranty but owning a M5 is very tempting..I saw an 2002 M5 on sale for 37k with 55k miles..Is it worth it?

This is a mega tough choice for most beemer fans. i guess if you like modern looks , don't mind a 6 sec century sprint, go for the e90 330i. If you just want raw power and sheer blinding performance, don't mind steeper depreciation due to the arrival of a newer model e60, one would not even hesitate and go for the e39 m5.

I would consider 2 things, but then again, for me money IS an issue. Privately buying a new BMW in Sweden is out of the question for me, because the value drop after ½mile is just not justifiable. On the other hand, the M5, although a pure dream, has some serious issues that need to be considered, mechanical ones. I have a friend who was considering the E39 M5 or the E39 540 with M-sport package. Actually, they did not differ all that much in price to buy, but the M5 is sick expensive to own over here, the insurance alone is close to $3000/year. If you want I can ask my friend what mechanical stuff to check for/be aware of. I remember that it, amongst other things, wassome part that does wear out quite often, and will have to be replaced, and obviously costs a fortune since it is an M5 part...
Anyway, he ended up getting the 540, and the grunt is quite enough....

My heart would go for the M5, and if money is no object, that would be my choice.
