Looks like the stock downpipe. If you bought from a dealer, they usually have to put the catted downpipe on to sell it.

Hmm, I thought for sure he said that it was the berk dp. The dealer had just got the car in on trade and had not made any adjustments to it.

Is there a way for me to tell for sure without tearing into it?

I know I'm throwing codes and I figured that was for the DP, but I guess it could be because of the midpipe as wel?

Actually just read the stock midpipes do not have cats, so I'm assuming since the proper codes are being thrown I do indeed have a non factory downpipe without cats. Would that be a good assumption?

The only way to know for sure is to scan the code(s) to know for sure.

Quick question for the pro's, I have a bone stock 2009 135i and I have a Berk street axle back on its way. Will this set-up hinder the performance at all? I'd like to leave the stock DP's and mids on the car (only purchased the axle back to slightly beef up the exhaust note...

no it will not hinder performance at all. most manufacturers claim HP gain but its minimal in all actuality. Axle backs are mainly for sound, Berk is a good choice in that most people like the sound a lot.

That being said, welcome to the forums. pay attention and you'll learn a lot here. Searching is your best friend on any forum website. Just a word to the wise, you posted in a thread that's from May 2012. Its not really a big deal but some guys get bent out of shape over this stuff (not me, I've done it before too)

Happy modding though, Berk is my choice as soon as income taxes come in

Non sure where your 2300 mile drive is taking you, but if you are going near SF I have a full stock setup on a 2011 and we can work out swapping a part or two.

pay a shop $100 to weld in 2 res's

ED: wow.. the berk street muffler looks like a no-name one lol, surprised it doesn't have a berk stamped on it or something :/
