Please do not go around blindly recommending everyone sue at the first sign of any issue with their car. Saying you can "legally" open a case is not the same as saying you are in a favorably actionable position. As long as I can find a lawyer to take my money, I can sue BMW tomorrow if I like because my blue car isn't white. Doesn't mean a judge won't throw the case out the second my foot crosses the threshold of the courtroom.

For the record: in YOUR state of NY (since lemon laws are state laws and as such you cannot make any blanket statements about them as you have above); on the FOURTH attempt to repair you will have legal grounds to initiate a lemon law claim (or if the car has been down 30 days or more). Further, I find NO information that suggests or implies that this number is lowered for a "known" issue (whatever that means).

I don't know if this is a repost but it seems the HPFP problem is coming out of the closet:

Those are pretty old articles... I think they will eventually issue a recall when they know they have a permanent fix. Until then, it's going to be hush hush patches and replacements.

Check out that dailyfinance article published today. After I settled with BMW, another driver contacted me whose friend is a class action attorney. Who told her that she can't open a class action until BMW issues a recall. I wonder if this is the reason BMW has been keeping this under wrap. Or will we ever see an official recall.

Varies on the lawyer. Word of caution is to confirm that is the case with lawyer one is working with. If that's the case there's no harm getting a 2nd opinion and alternative option if settlement doesn't pan out.

I'd still exhaust bmw's 3rd party arbitration process before giving a green light to lemon attorney.

This can be a manufacturing defect. The fault tolerance must be very tight. Doesn't make much sense some owner have no issue at all while others are multi-offenser

Update:

Today is day 17 my car has been in the shop while they try to figure out what the problem is. I spoke to the service manager this morning, and he said they are putting in an updated HPFP, which would be great, except that the last one put in my car was the 943. I asked him if there was something beyond the 943 to which he said yes, it's a 402. Seems odd, since I've never heard of a 402 pump, anyone heard anything about that?

Regardless, I should have my car back within a few days, they will be replacing both the HPFP and the low pressure fuel pump. I hope it gets rid of my issues.
