I sent Leo an email with some questions regarding this ECU Flash.
I will post his answer once I get a reply back from him.
This seems to be a better solution than the JB3, my only concern is that since I live in FL I hope there is a way for me to do the OBII flash my self with out having to send the ECU to them.

I got an email response back from Leo @ Alpine, he gave the parice, I would need to ship the ECU out to them and back, he said that flash is invisible to the dealer when I have to take it in to service..... not to confy with this...... still trying to figure out what I want to do, either install BMS JD3 stage 2 (or what ever is the latest) or do the ECU Flash from Alpine and run the risk when I go in for my first service or if any (hopefully not) warranty work.

Any toughts?

Basically no mod is totally safe. IF you want to play (mod) than you have to be prepared to pay.

Some say that even a JB3/4 or Procede can be detected - even once removed. The dreaed tuner codes thrown. This has been hotly debated in the past. Even IF you had a juice box (JB3) or a Procede that was plug and play... a good tech at any dealer could tell you have been moving clips and gromets around - under the hood. With a SW flash you don't have to mess around under the hood area.

Even with the various flash tunes availible... IF pust came to shove... and an regional service manager or a engineer from BMW were to look at the line code from your car... perhaps they could tell you have been runing a tune.

But for the average tech at any BMW service dept... I think the chances are quite low they would know you have a tune. Unless they were to drive your car and FEEL the (increased)power output.

Over here on 1addicts there are MANY juice box users. I think the gerneral opinion is biased towards the JB3 products over here. Just as is, on the e90 foorum... MANY member over there are Procde users and gerneral opinion over there is with that product.

I think you just have to research the tune you are thinking of going with.

For me I did not want to be constantly messing around with engine check lights and reading various codes or uploading new SW or SW versions every few weeks. I wanted something that would just plain work(!) from day one and forget about it. That is what I have in my tune. No codes, no driveability problems, no hickups or engine problems. My car drives just like the original BMW SW, just that I have now 380 Hp instead of 300 Hp.
