Oh man, do I have a story to vent about

My car was damaged by the dealership about two weeks ago while I was getting my HPFP replaced. No, this story isn't going where you think. I was scheduled to get a loaner today since it was the earliest day available for what the service manager called "the fun loaner." I was looking forward to having a car other than my own to drive in the autocross this weekend in Nassau. My appointment was for 7am this morning.

I go out to my car to drive up to the service center only to find the drivers side door, door handle, and side skirt dented and smeared with red paint. Low and behold, there is a red Pontiac parked behind me. I go and check the back bumper of the Pontiac. Low and behold, Lemans Blue paint.

Called the police for an accident report. They showed up quick, like 5 minutes. People who get shot have to wait longer for cops to arrive. Anyway I showed the cop where my paint was on their bumper and theirs on mine. I won't get the report till Thursday or Friday, but I'm certain it'll say that the Pontiac is at fault.

I waited around to talk to the owner of the car. She came out with her boyfriend and denied up and down that it was them. She said she was "too fucked up to be driving last night", which means I'm sure that whoever was driving her car was completely sober last night too.

Sorry, i clarified it a little better in the first post. No, this was before I brought the car in. my car got hit the night before it was supposed to go into the body shop for repairs BMW was paying for. Now I have to go through my insurance.

Yea, I just have to wait till I get the police report. The owner wouldn't give me any information at all, not even her name. I think they are under the assumption that it's going to be a no fault claim. After running into them I feel like its going to be one of those uphill battles though. I'm going to get an estimate from my preferred body shop and see what the damage is.

That is too bad man.

You know over here in the land of big brother ie Germany. All you have to do is call your insurance company... give them the plate number of the suspected car... they will give you the owners name, age, gender, address, tel, AND insirance company!!! Then you can make a claim against THEIR insurance!!! And then call the Polizei. You have no privacy rights over here.

And ohh.... did I mention that the cops can pull you over anytime for anything! No probable cause needed. Just to check "zee papers"! It is not so bad no since we "americans" have German plates - so we blend in. But back in teh day when we had special armed forces plates... it was bad. We called it "driving while American"!

Yea, hitting a car and not leaving a note is a Class E felony or something like that in NY. Hopefully some justice comes out of this.

edit - it looks like its only a felony if you hit someone and injure them or kill them? Does mental anguish count as an injury? Looks like if its only property damage there is a maximum fine of $250 and a maximum sentence of 15 days in jail or any combination thereof.

That is nuts, but I'm willing to bet these degenerates who hit my car wouldn't be able to get a license in Germany. Sounds to me like the Germans have great engineers and great lawyers.

Thanks Derek, appreciate it. I was going to take a drive out to you guys for something else, but these repairs are going to be done at a shop I can get to and from with public transit.

Is the Pontiac's damage on the right rear bumper? It looks like she backed into you while trying to parallel park, maybe (turned too hard or too early). I can't believe she just proceeded to park like normal after that. What a first-class idiot. It sounds like she really WAS too fucked up to be driving, lol.

Thanks Frank, and yes. This is the second "hit and run" incident with this car. I had another issue where the dealer nicked the quarter panel while I was having the HPFP replaced but they were really good about it and were going to fix it and "take care of me" as they put it. They lucked out because now the small blemish they left will be fixed because of this larger incident.

Hopefully I'll have her back in time for the meet in a week and a half, assuming they can get the parts quickly. On the upside, I can probably get the body shop to install my GAS diffuser for me while the bumper cover is off.

Yep, its the right rear bumper on the Pontiac. Unless she hit another Lemans blue BMW (there is a Lemans e90 335i about 10 blocks away actually, but it was unscathed when I passed it later that morning) that is also my paint freshly transferred onto her bumper. I know the scaling sucks on the pictures, but you can correlate the rubbed paint and big scratches on her bumper to the damage on my door. Even the cops were like "wow, who hits someone and parks behind them?"

Update - My body shop quoted me ~ $2,415. How someone can hit another person's car and cause that much damage without leaving a note, and to top it all off vehemently deny doing it, is beyond me. God I hate the Bronx.

You are spot on, the cops can't do anything and statute 600 would only apply if a police officer actually saw the accident occur. No legal justice for me unfortunately.

Car is going to the shop next Tuesday, after the new door arrives. They said it would take about a week to finish the job. Looks like I won't be making it to the captree meet.

On the plus side, the dealership is willing to work out something for their damage to the car. If the car isn't detailed by the body shop, the dealership will do a complete detailing for me. If the shop does detail the car, maybe I can convince them to give me a nice discount on the performance spoiler or a couple of rotors.

So since your car isn't going in till Tuesday that means that u can autox on Saturday right

ohh and don't let the lack of a car stop you, the supercar meet there every Sunday is worth it on ts own. Last time we did captree I showed up with an x3 loaner as my car was down for the day

Better yet, take it to my friends shop in jersey and so long as he can get parts it will get done in time for the meet. He does great work and prices are reasonable.

Worst case if u can train it to jersey you can ride with me.

Thanks Frank, but I have paperwork signed already with a shop near my house. They do amazingly good work and they're going to do some touchup work on the hood, a paint correction, and install my GAS diffuser for nothing.

I'm trying to Pete into going, I'll see him tonight at some point and get him to commit. Actually this may work out. Since I'll be riding in a vert, I can get some decent rolling shots of everyone. I'm hoping to make my HDR debut after shooting this meet.
