Debadging story

OK, so I am behind a dumptruck on the interstate (83 North of Baltimore), going up a hill just after the 55 reduction and I am doing 50 - he's getting slower and slower and dropping more and more stones on the road - I venture into the left lane to pass, and do it with haste (75MPH) so I don't get more chips than I already have - a cop is there - I'm pulled over, he takes my license - nice guy.

Comes back after an eternity and says,

"I can't see any model number on your car so I had to make one up". So I have a Model 1800 BMW... at least that's what the ticket said LOL

Not sure what to make of this - he did not ask for registration or proof of insurance (although I had them in my hand when he arrived at the window) and he did not ask me 'why' I was speeding (not that he has to, but most have). It was a PA State trooper.

What do you think?

You got a ticket for 75? Sorry to hear that. I didn't think anyone ticketed under 80 (which is basically my default speed on highways regardless if it's 55/65).

The cop left you an out! By the cop not including proper vehicle ID, AND not asking insurance or reg he wont even show up in court. Tickets are tossed out for a hell of a lot less than that. Your not fighting the speeding it's the details on the ticket.
Be surprised if you had to pay.

As long as the manufacturer and color are correct, the ticket will hold up in court. I previously received a ticket in my silver Mitsubishi Evo, the officer put my car down as a silver Subaru - ticket still stuck .

If, however, the officer did not sign the ticket, you are in with a good chance.

Agree that you were driving this "1800 BMW" car. Apparently it only has 90 base horsepower. Argue that there's no way you could have made it to 75 mph

Oh, and no... Incorrect "Model Number" on a debadged vehicle will not automatically void a traffic ticket... otherwise, we'd all be debadging our vehicles in hopes of confusing an officer of the law. lol But let's not be silly now. If the cop shows up, the ticket will likely stand... but if you're really concerned about the model number, I guess you can have the ticket amended by the officer to show the correct info.

I'd certainly like to see the judge's reaction to that defense though...

What I don't understand is why didn't you try explaining to the cop that the truck was spraying rocks everywhere and because you didn't want a cracked windshield (safety concern) you made a quick pass. its up to the truck driver to secure their payload, that was a driving hazard you were trying to avoid...thats a perfectly reasonable excuse...

With all due respect, another perfectly reasonable excuse would be to slow down and create more space between you and the truck.

Not that I'd do that, I'd pass him in a heartbeat (or 2 or 3, cause I drive a '28i).

That's because you live in MASS where people think traffic laws are just sugestions. I can't tell you how many times i have been passed as I do my typical 10 over the limit. and by passed i mean like i was going backwards. Or almost t-boned because the idiot across the intersection from me floors it and does an imediate left turn in front of me at the first hint of the color green. Do you people know what the phrase "right of way" means...dont even get me started on round abouts (traffic circles). Ok i am done. moved out from WA last year and am thinking of becoming a cop just so i can have the higest ticket count EVER!!.

My first speed equipment on any car I drive is my Escort 8500! Don't leave home without it. I even have it on my motorcycle and it beeps in my helmet! Hell, the way I drive I would loose my license if I didn't have it! In Ohio, all the cops do are write tickets so beware if you are on our state! BTW, nice to see you still drive a classic BMW 1800 daily!
