Post New 128i Convertible rear headrests Issue?!

My mom recieved her new 128i convertble about 2 months ago...the car was ordered and delivered to our local dealership...

Being her second E88 128i convetible (prev was an 09') She quickly noticed that the rear headrests won't go down. They are raised up high...and being a 5'0 woman she can't get a good view out of the rear view window.

My 2011 128i convertible is like her old 09' 128i...the rear headrests are flush to the bottom...not raised up at all.

My dad, president of the bmw cca in our area is also a 1 series owner(1M). He doesn't understand why head rests came like this and won't go down. Simply put. They won't go down.

The dealership has yet to give my mom an answer...even after looking at it and saying they would get back to her on the matter...
Weeks later they are just trying to sweep it under the rug in hope that she won't complain about it anymore (my assumption).
No answer to this date.

Why the hell won't it go down. I'd say it's positioned about 2-3 inches higher than my rear headrests on my 2011 128i vert. (I've never raised mine...or had a reason to do so)

Info/Advice appreciated..

Since no one has yet to give an advice, what I would personally do is just take my car in for service and tell them it's broken.
(Just to make sure, you know you have to press in the button at the base of headrest to push them down, right? At least that's the case for most cars. Not sure about 1 series)
