Thanks Ward! THE JEDI, sorry about that, I didn't know what you mean by "did ya go shit my bimmer" ...the kid had full coverage insurance (it was a Lexus) and it was not stolen (actually I keep saying kid, but he is the same age as me, 24). I rented 50 cent Get Rich or Die Trying, it was ok. If you liked 8 mile, then you will like this too. I really do not think that I can wait for the 335i, unless I buy a used car now and trade it in 9 months or so. Paddywac, you were right....good judgement and better for me, but ONLY because I have that additional GAP insurance from BMW, otherwise I might be fu@#ed with depriciation. I will find out tomarrow morning though on what the situation is and how fast I will get the check. I'll keep all you guys posted though.

Wow now another reason not to rent that movie .....but hey do whats best for you , hell I wish when I was 24 I was rolling a bimmer ......one more question is this gonna affect your insurance...I sure hope not .....and nope didn't like 8 mile...but I will tell ya a good movie...."Kingdom Of Heaven , Jedi waiting for the 335i coupe.......

For those that live within 75 miles of Chicago, I really need your help, please!!! The insurance co. called me and said that they are giving me $38,500+tax , so almost $42,000 for my car...and I owed $200 less than that, so the car is paid off now. When I asked them what they based that on they said they took 3 cars that were CLOSE to mine in my area and took the average price. The problem is that all 3 did not have sport package nor navigation. Those are almost $4,000 in options left out!! They will not give me a higher price unless I find one with all my options (see signiture) on a dealer lot within 75 miles of me. I already did the cars.com search and checked every bmw dealer and came up with nothing. I'm sure that there are 100's of smaller independent or other make dealers around, some might have a used 2006 330i with those options.

There is not one car in the country that had the same color combo's and options that I had, and I think that I will have to order a new one, but I am out $4,500 as of right now (my down payment) in order to be able to buy a new one again. That is why if I can squeeze another couple grand or so out of them, I can get another brand new one. If anybody can help me, whether you know somebody in the business, passed by a dealer w/ that car on the lot, or know of independent places that sell luxury cars, I will greatly appreciate it.

wish I can help...I see a 330i sport (similar specs as yours) listed on ebay - DFW area (click here ) for $42,888 (3k miles zsp,zpp, navi, pdc, sat radio etc.) Not sure if that'll help. Good luck!!

Alternate plan: escalate within the insurance company. This is ridiculous since most BMWs are custom ordered.

I could see them doing that with older cars, but that is bullshit. What, they can't go to "build your own" and see what it costs? Why does it have to be sitting on a dealer's lot??

As jspira advised - escalate with your insurance company. Be nice, but firm and keep saying "I need to speak with your manager" until you get someone with some sense.

Being that I am a claims adjuster for a major car insurance company I can say that they need to a little better than that.

I'm from NY so I know the laws here. I'm not sure about the laws in your state.

If you want I can call one of the offices in Chicago and ask them. OR look on the internet for the state website that has the laws that govern insurance. There must be some kind of law out there. Here in NY it is Regulation 64.

The way that they valued it is wrong because they did not compare apples to apples. They must take into consideration the options that you have. If they don't then it is not a fair market value for the car.

I'm really sorry that you need to go thru this. I would be interested in what insurance company it is though.

When escalating, I go the manager route once. If that fails, I don't waste my time going up the line - I just look up the CEO or division GM's name and call. 100% success rate with that.

Craigar, since you are in the industry (and I hope you won't mind) what is an insurance company's obligation in NY to provide for diminished value?

You can't diminish the value of a car in NY because of an accident or loss. With carfax and all that stuff out there people will try and lower the price (car dealers) because of that but per the law they cannot. It might make it harder to sell but unless it was a bad repair it should not change the value of it.

NY has so many laws that are ever changing so I expect something to change. I know my car policy now has an exclusion in it for diminished value. Meaning it is not covered. Ohh well.
