The nurburgring is considered a one way public toll road with no restrictions during tourist rides. Since you do not need a helmet to drive on public roads in germany(minus bikes) you do not need a helmet to drive on the nordschleife. Similar situation on hockenheimring... Everything is at your own risk, no one holds liability except the drivers themselves.
