If this was me, I would have asked for a new car... I know it sounds crazy, but they committed fraud and that's very bad. Glad you're happy with the outcome though Zuzu!

Question then Joe is, do you have to take it back to the shire to take up any benefit you have now negotiated as a result of their 'issue' or is it a documented resolution that enables you to take your car to any BMW dealership?

while joe seems happy with the outcome, which i am sure came with a lot of joe wiping the slobber off his arse I'd have a real problem with trust. Joe I have a good supply of white markers if you run short.

Well you are not going to believe this, it is a sad but true story.
Yesterday a new client dropped of his car for me to check out and appraise before he goes to the dealer with a gripe a big gripe. He was on his way home and decided to fill up the fuel tank, but by mistake he put petrol in the diesel tank. well he drove off 400m later the engine stopped. After contacting BMW road side the X5 yes another X5 was towed to his usual dealer as he purchased it new and has used these guys for many years. The dealer did a complete check over and said the engine was damaged beyond repair the price was $40,000 - $45,000 to replace the engine and fuel system. Next step was to contact the insurance company and have the X5 assessed the insurance company agreed to come to the party and made the decision to right the X5 off. It was at this time the dealer found out from the assessor that it was to be written off, so they took it upon them selves to remove parts and swapped them with another X5. Now at this point the insurance company decided not to cover the owners mistake and declined the claim. The X5 was picked up from BMW and taken to a local workshop were they cleaned out the fuel system replaced the intank pump / filters and fired her up all seems OK, The owner picked up the car and on the way home decided to ring the wife to tell her the good news, WELL WELL WELL this is where it all unfolds he pushed 1 on the address book, the phone rang but a guy answered the phone, well after some discussion it seems that he was the owner of the complete satnav, DVD system all of his details are still in the unit as it was when he traded in his X5 at the BMW dealer. But that's not all there are no head lights, and there are many fault codes infact two pages on Autologic He rang today as there is now another issue the trans has failed there is no drive and a knocking sound from under the car. It is being transported to Advan in the morning I will have a look and see what else they have swapped around. As this story unfolds i will keep you informed. BUT IT IS THE VERY SAME DEALER AS THE OTHER X5 AT THE START OF THIS POST. Very sad but true |

Thats absolutely pathetic Pete.. Seeing they are a privately owned dealership, they can get into some serious legal hot water from BMW Aus..
Your client has to report this.. Plus its the sister dealership of my scenario.. |

I know of a 1er diesel that was filled with petrol. The vehicle was subsequently written off. It will be interesting to see if it is "re-birthed."
On a side note... the new diesels have a magnetic gate that prevents the entry of a non-diesel nozzle. The diesel pump nozzles have a magnetic ring at the tip that activates the gate and allow the nozzle to enter. Kind of like a chastity belt....

Would be surprised if BMW AU take action... this has obviously been going on for years... and like any entity the corp culture is set from on high... if they keep it internal it will be washed under the rug...
If you are serious about action... First go to your local police station and lodge a case suspecting stolen goods... get a case number... (just the headlights if you must) Then call your insurance company advising them that you are suspecting insurance fraud may have occurred, provide the details and the police case number that you have lodged. you can then contact BMW Australia and advise them that this has occurred, you have reasonable suspicion and have lodged a claim for stolen goods with the police, combined with suspected insurance fraud with the insurance company, provide them with the case details and insurance contacts. if you are still a bit annoyed, you may also lodged a complaint with the ACCC... Alternatively you can advise the dealer and of the above steps, and see i you can get a set of floor matts and an extended warranty... ... also the above is far more civilised then i would do, last time i was in a similar situation with a boss who tried to commit insurance fraud... i politely reminded of what was required to keep me quiet if he went down the path... he did the right thing... (morally.. not in my benefit)
