Advise on possible wheel swap

hey folks I have an unusual opportunity after putting a nice dent in my 18" OEM 162 rims, here is the deal
found a local with 19" e92 M3 wheels (tire & rim) 245/35/19 265/35/19 about 3k miles on them
and another with 17" m sport OEM 225 (no tire specs) with about 185 miles
I like the look of both styles but my question is more performance (and will the 19" 265's rub dealer was unsure)
price is a bit high on 19" but "doable"
any advise?

OE M3 wheels/tires will cause rubbing issues and will require a narrower tire as well as fender rolling.

Im not sure that they would even be contained by the fender at all. What are they a 9.5 et 23?

Yes 9.5 /23 and that was my main worry, surprised my local BMW dealer seemed to think they would fit. The 17" 225 style are a great deal ($1000 tires/rims pretty much new) but I have never gone down to a smaller rim/wheel size, it is a temptation since the 17's would have a slightly more protection against bending another rim, suppose I could just drive slower--->but that's not going to happen
