Ok "Please Explain"

I have a couple of questions for anyone who thinks they can answer them.

I came across the below in a couple of articles.

"Twenty five imported car models - including the Audi A4, BMW 3 series and Jaguar X-type - would be exempted from the tax altogether as a result of the change. "

What are the 25 models???

"The Senate also agreed to Senator Xenophon's request to apply a sunset clause to the tax's indexation to the controversial consumer price index for motor vehicles (CPIMV). "

WTF does that mean????

"Under the Greens amendment, the tax would no longer apply to cars valued up to $75,000 which use no more than seven litres of fuel per 100 kilometres."

Hmm is that City / Highway or combined consumption? Because if its highway I get 6.5 km if its city I get 11.7 km and combined is 8.2 km....????

Bastards. But this is something that I didn't see before:

It also approved Senator Xenophon's request to ensure the increase would not apply to people who entered into contracts before the night of the Federal Budget in May, when the Government announced its plan.

Interesting. If I recall correctly, I signed my contract before the budget was announced. Was budget night the 13th of May? I signed the contract on the afternoon of the 13th. Bugga, I then changed the contract to add NAV, that may be my undoing.

I'll take a punt.

The 25 vehicles will be largely diesel models. I checked the consumption of the every petrol 1-series and the best was still >7l/100KM

I expect it's going to be the manufacturer's combined rating which makes sense (I know common sense is dangerous to use but I'm going to go out on a limb).

I did some reading on the CPI(MV) and found that I'd take up far too much of a page to condense it here. Basically it's a very disputed form of measuring the CPI for vehicles that allows for discounting in certain areas. This is why the LCT threshold hasn't increased inline with CPI as a whole.

A further note, when I said "largely unbiased" I exclude the following comment-

"In its favour, the LCT is a progressive tax which is relatively easy to collect. It is equitable in that it taxes those most able to afford it."

Why don't I just go and buy the groceries for the next 100 people at the local supermarket because "I can afford it"?

Kevvie and his millionaire missus should buy me a fully loaded 135 coupe -- because they can afford it. In fact, they can probably afford to buy one for all the forum members. What do you think?

That's about as logical as their arguement in favour of the LCT. Perhaps if we offer to support the greenies in their campaign to have "Loud burping, pidgeon- toe'd, wide winged dribbler" declared a national treasure, they'd support us in the senate.

You are already buying groceries, paying mobile phone bills and gambling debts for a proportion of the population. It would be nice if the Rudd government would actually thank you for working hard and contributing extra to the community purse rather than vilify you in parliament each day.

And we're paying for the alcohol, drugs, legal aid, prison costs etc of many. Everytime I walk past the polkies area in a pub or club I see where much of my tax money is spent. There's no way you'd catch me in there. I know what the odds are & I know how hard it is to earn the money I've got.

Here is the wording from the proposed amendment:

Schedule 1, page 3 (line 11), at the end of item 2, add ", except where the contract or other arrangement to make the taxable supply or the taxable importation of the luxury car was entered into before 7.30 pm, by legal time in the Australian Capital Territory, on 13 May 2008".
My order was placed on 16 June so even if the above was signed off, I still miss out. Bugger. But it looks like you might be OK SimonB.

I've not really been following this too closely as it only infuriates me... but essentially, can I assume a refund given that I ordered and placed a deposit back in April?

Yes, provided the legislation passes with no further amendments. It's been handed back to the lower House now, gets given back to Senate, then comes into effect.

I'll be interested in seeing how this is dealt with. I have a copy of the "Offer to Purchase/Invoice" in my hot little hands, dated the 13th of May - it will be very interesting to see how this is dealt with, considering that I resubmitted another when I decided to upgrade to the Nav. Does the first one stand, as it was the one that caused the vehicle to be ordered?

Ordered two cars on 17 March, so looks like a refund is on the way. The second one, LeMans Blue ordered for a mate only arrived on the Tosca last week and will be delivered tomorrow in Adelaide. Bet he still pays...
