Is a total loss(auto) negotiable??

My car was rear ended a couple of weeks ago. It's a 2003 Acura rsx type s been in the family since. Estimated repairs will be $5XXX but the adjuster wants to give me $41XX($5600 minus $1500 in adjustments). To buy it back it will be $13XX. What should I do.

Whats the market value of the car atm?
He compared it to 3 Rsx's in the area and came up with an average of $56XX.xx. Then he deducted $1500 for condition leaving me with $4168.

I would take the money and find a different used one if you want to keep an RSX around. They can be had cheap now since they've been out for quite some time now.

Or you could spend an extra $2k and find one with lower miles.

I want to keep the car because it's been a great car I just feel that it's worth more than $4100. I just emailed him an offer to buy the car back for $1000.00. Should I have mention to him that we're not gonna sue his client even though she rammed into my son at 40mph.

I know I've said it before already but I got rid of my '04 Rsx Type-S for $5,300 with 180k miles and some shit done to it. That was what the BMW dealership gave me, I was trying to get $5,000 for it privately. Not sure the condition or how many miles are on yours, mine was pretty immaculate inside and out, just high miles. It really was a great car, and probably still had another 100k+ to go.


I don't think making that statement would change anything, other than making it known there wouldn't be any extra hassle on everyone.

Sure it's negotiable. Just get someone on your side who's as powerful as a big insurance company. Otherwise, it is what it is.

I take it you're dealing with the other guy's insurance company. FWIW, my personal strategy is to claim on my policy, and let my insurance company slug it out with them. More of a fair fight. I have to front my deductible, but that's the first bit of money they get, and then pay me back.

YMMV.

It would have to be a salvaged title for you to buy it from insurance. You don't care now, but future sales will plummet even further. . .

You don't want to be stuck with a tainted car. Buy one the same color and forget about the sentimental-ness, it's not smart.

No I'm not worried about resale value. I bought it from my kid brother who had it since it was new. I was using it for a daily driver and will hand it down to my son(He learned to drive a manual in it). I just think it's not fair that the Insurance company is giving me a check for $4100.00 for the car and sell it for $1300 to the salvage yard. They'll be out $2800 while i'm wasting my time looking for a replacement with $4100. If I had the option for them to fix it, I would make them spend that $5000 to fix it.
Anyways, i just talked to my brother and he's gonna buy it back because that's his baby. He's gonna turn it into his project car and "rice" it out.
Rotorocious- My son was driving my car and a girl rear ended him at a stop light. She was going so fast it caused him to hit the car in front of him. She did get a citation for failure to slow down in a construction zone. My son is 18 and right now he thinks he's indestructible.

We just stripped it and most of the damages are on the outside. We found a type r conversion on eBay with all the parts we need for 1100 and my nephew is gonna plasti dip it.

Why are you going through all this trouble on such an old and damaged car..... I just don't understand.

And you cant see frame damage, it needs to be laser aligned back into shape.

I don't know, i guess it's sentimental. My kid brother bought it since it was brand new and we're the only 2 that's driven it so he knows it has been taken care of. I'm a little sentimental too I like to hang on to my cars a bikes longer than I need to. I regret selling my 01 330ci for to my sister for $5k thinking she was gonna give it to my niece. When I asked to buy it back they had already sold it to their landscaper. She said my niece wasn't trying to learn manual.

I had an E36 that I loved [just sold after 10 years] - I "totaled" her per my insurance companies decision.. I took that check [5K] and bought her back [1500], replaced the clutch along with the cat/exhaust that = the total loss part and drove her for another 80K miles..

Best car ever.. drove her like I stole her every time
Never failed to start
Never gave me any shit..
In/out of it for 4K total [minus tires/wear/tear] over 10 years!

Best decision ever and when I sold her [knew she would be OLD & would be worth very little anyway @ 184K] since there was no frame damage involved in the total - it wasn't really an issue [think she is bound for strip/track..]..

Sometimes buying the salvage back is worth the time and effort..

I too tend to get super attached to my cars
