Bmw Trying To Say I Had A Tune On My Car ?!!
Hey,
im having a problem, the other day i was driving and i never had long starts or any signs of the hpfp going out. i was just driving and all the sudden my idle got really rough, started bogging, sounded funny, then came the SES light and 1/2 engine power. i just figured it was the hpfp and brought it in i have NEVER modified any engine or drive train component, the only aftermarket parts i have are basically kw v3 and csl reps. he called me this morning assuming i had a tune on my car and comes at me saying " what software or tune did you run on this car" i was baffled !? wtf i never have had one i told him and said thats the cause of my problems. im so pissed right now, when i refrain from modifying the engine they are trying to blame me for it. he said they are gonna check it out more but thats what its pointing to what should i do ??? |

Did you buy the car used and maybe there is evidence of a tune from the previous owner? Either way, it sounds like they were immediately putting the blame on you which is BS.

No, they see his car is modded, splitters, vinyl roof, CSLs, drop and they just refuse to touch it thinking if the guy went this far with it, its probably tuned and just wants to shaft the customer for the $.

I'm afraid your mods have done you in! It is sort of like if the cop stops you and your blood alcohol is above the legal limit and if you were in an accident, then the law presumes you were at fault unless you can prove otherwise. So they saw the mods on your car and are assuming the problem is due to a tune you installed. Of course, even if you had a tune on it, they legally have to prove the tune was the cause of the problem you are now having with the car. They cannot legally say that we will not do any repairs on a car with a tune. Right now they are just "fishing" with you to see if you will admit to having a tune on the car, so just hold firm to your position that you have never had a tune on the car and tell them you expect the car to be repaired under warranty.

he called to "update me", i said there was no way that there was any tuning device installed in this car and what brought them to think that. he said there was "none bmw information" showing up..not sure what that means. then told me that they are going to do a software update

You should definitely talk to the manager or GM of the dealership. That is no way to treat a customer especially when the HPFP problem is so well known.

God even WITH a tune if it is your fuel pump that is a known problem no matter what... I can't see how they could remotely argue with you...

From what the advisor told you, it sounds like your software may have gotten corrupt. It happens all the time on computers for unknown reasons and files that were once fine suddenly have errors in them and that's what it sounds like to me and that is why they are doing the software update to replace the corrupt software. That may be all that's required to fix the problem or it may be masking another problem such as the HPFP failure, but they can't tell until the software is working properly.
