My totalled 1-week old '06 330xi... finally settled with insurance company
I had bought a brand new '06 330xi back in October, and then one-week later, with only 200 miles on the car, someone crashed into me.
Story was in this thread... http://www.e90post.com/forums/showthread.php?t=8305 So, after some negotiating with the insurance company, here's how the valuation and settlement played out... $45,995 - MSRP of the car (I paid $44,995 after... yes, not a great deal but in October, there were none in stock anywhere and I was hot to get the car so I felt this was reasonable considering supply vs. demand at the time). vs. $46,320 - Valuation from insurance company based on 3rd-party company, ADP, calling 15 dealers to see what they would charge and calculating an average. This process was necessary because the insurance company refused to "just pay me what I paid for the car." So, their breakdown was... $46,320.00 - Actual Cash Value $2,779.20 - 6% NJ Sales Tax $10.00 - Transfer Fee ---------------- $49,108.20 - Total of settlement Since I paid $48,237.40 out the door (including $345 for registration/title and $198 documentary fee), I'd say I made out more than favorably. No, I have not replaced the car yet nor placed an order for a new one. I want to, but I'm going to wait a bit, as I'm still feeling overly-paranoid after being randomly hit. |

That's awful about the accident, but that's great news about the insurance settlement!
And I definitely know what you're saying about the post-accident paranoia: I got badly rear-ended about four months ago and I'm still not entirely over it ("I'll never get over Macho Grande.") -- I find myself constantly checking my rearview mirror. But I like to turn a negative into a positive whenever possible, which is how I ended up turning in my totalled Acura TL for an E90... I'd take that extra $870.80 you're getting from the insurance company and treat yourself to a spoiler or carbon fiber lips on your new car! Whatever you end up doing, good luck!

Ok...I know you getting over the post accident gitters...but the chances of lightening striking twice in the same place are virtually impossible.
Go back to the exact same dealer, the same sales person and tell him this is now the second 330xi you are buying from him and you want a good deal. Insurance paid you out quite favorably? Use it to your advantage- get the same car, better specced and keep in your new "budget" (What they pay out was) The dealer should be willing to negotiate now seeing as it's a 2nd deal. And you sounded happy about the safety of the car in your last post/ The new one will only be here in around 2 months anyways...plenty of time to relax about it :-) I'm glad everything worked out - and you are okay! My advice is milk it, milk the situation now for everything it's worth... |

I hit a tree with my 6 month E90. I was trying to avoid rear ending the car infront of me and my instincts pulled me over to the grass curve area and I hit a tree. Damage totals 3K. Luckily the Left HID Xenon was not destroyed, just the front bumper, front absorber, left headlight washer. But the collision center said the frame was bent (Which is my deepest worry the handing won't be the same ). Before I hit the tree my car went into a 3 ft ditch, I think it absorbed some of the speed I was traveling at, because when I hit the tree my airbags did not deploy. I have been waiting about 1 week for my baby to return to me.
Your accident looks pretty bad, I guess if you could take anything positive from this, you came out with your head still attached to your head. Still I regret that your car was completely totaled in the manner it was. Rest In Peace KMA's 330xi. |

Very glad to hear that things worked out so well for you. Still, it is a terrible process to endure. Are they keeping you in a rental until you obtain your new car? You should factory order exactly what you want.
I understand your paranoia! You just have to get back out there.

I think it's God's will that you buy a 335. THat's why he took away your 330xi while not harming you. You better buy a 335 or else you'll feel his wrath. lol

Luckily (more divine intervention, BMWE90? Maybe.), I still have my '00 328Ci (deal fell through with propective buyer and then all the other responses to my online ads were from bogus Nigerian sources) and my wife's '01 325i... so while oldies now, they both run great and both have low miles. My wife got me a Garmin Nuvi 350 GPS for xmas to help me deal with my bad directional skills that the 330xi's nav system were intended to straighten out while I figure out timing of my replacement (i.e., and then we'll move it to her car once I decide). I must say, I never realized how much nicer a touch screen can be (Sorry, bad pics. They are from a replacement cell phone my wifey also got me for x-mas, a Nokia 8801. Better pics than my old Sony Ericsson, but still overall low quality). |

Glad to hear it worked out well with the ins company. Sounds like they may have factored the $600 post-September BMW price increase but, either way, they took good care of you.
Funny, a claims adjuster once told me "that's what insurance is for". It's true, that's why we pay thousands in premiums over our lifetimes, so its good to know there are good companies out there that take care of us without having to fight them.

(a) Subrogation claim in which the other driver essentially admitted 100% fault (i.e., therefore my insurance company had incentive to keep me happy but overall planned on charging/suing the other insurance company) (b) Car had literally around 200 miles on the car, so no one could argue against it being brand new (c) I'm a big pain in the ass in general with my insurance company--with every line of insurance they have (auto, home, life, umbrella, etc.)--so guessing that I'm in their top level of customer stratification.... Maybe not, but guessing such *could* [maybe] be the case) Last edited by KMA; 12-30-2005 at 06:11 AM.. |

I got the crap rammed outta me last March in my 325i...only 10k in damage tho...but I was paranoid for months after that. I'm okay now, about 30,000kms later. My wife also hit someone in her X5 last december 31st (15k in damage and she is still a bit freaked out).
Good luck on a replacement - take your time and decide what you really need...a 335 or an 330xi. The 330xi is a ripping car, and the xDrive is incredible, in case you haven't driven it in the snow yet!
