Returning Deposit?

I had placed an order for a 135i and left a deposit. I'm no longer taking delivery of that car because of the horrible experience with my CA so far, i.e. can never reach my CA about anything such as status of the order or financial options and never returns my voicemail.

Now I'm trying to get my deposit back and I'm wondering how I should approach it. I've left 2 voicemails over the last couple of days requesting for the refund but again, I can't reach him and he hasn't returned my calls.

I'm going to give him the rest of this week to respond, but what other options do I have? Going to my credit card company to dispute is the last resort as well as a call from my lawyer. I'd like to handle this with the least amount of complications as possible.

My first suggestion would be to go there in person. If the CA think's he's losing the deal then there is no way in hell he's calling you back.

Come on, a lawyer over 2 unreturned phone calls? Is your car in production yet and have you signed anything? If so they may try to keep until it's sold to someone else. Call the manager and see what your options are.

Show up in person, speak to the sales manager and ask for your deposit back. If they refuse...call your CC.

I've been in this exact position before and did not get satisfaction from both CA and sales manager (2) of them. I eventually got it after disputing the charge with plenty of documentation.

Haven't signed anything but it finished production and as I said before, a lawyer is the last resort.

Keep going up the ladder, at the dealership. You should be able to get it back without contacting the cc company.

This deposit is 100% refundable without any paperwork right? Just making sure there's no tricks up their sleeves that they can use.

Unless it says somewhere on the sales receipt that refunds for deposits are non-refundable, you should be fine. You have no car yet afterall, just a promise for one.

My CA actually called back and he says it'll be processed in 2-3 days. Woot!
