Good Deal?

Just wondering if I might get some input on the following deal:

2008 135i Jet Black on Black Boston Leather and Gray Poplar

There is some wear on the driver side seat bolster.

New rear tires.

Glad I asked. Edmunds had it at around $40K. Is the issue the mileage alone or is it mileage at the asking price? What would be a reasonable/good price?

You could get a new one with 0 options... Yes that CPO car is priced slightly too high but it also has 10k in options...
