Speeding ticket in Upstate NY

Today I was in the catskill mountains in NY on some business. The road is a single lane road for each side and at times there are dotted lines allowing you to overtake a car. Normally, I drive teh speed limit and am a very relaxed calm driver. I live in Bergen County, NJ. Either ways I'm behind a Black Durango who's going 55. I see dotted lines and decided to over take him, downshift into 4th and floor it. I hit about 91 and as soon as im about to merge back into my lane the cop hits me with the radar gun. I told him i was overtaking but he believed i've been speeding all along. What do you guys recommend I do? I'm thinking of going to court with a lawyer in an attempt tog get out with 0 Points. Do any points transfer? If i get away with 0 points in NY how will that affect my NJ points. I've never gotten a moving violation if that helps. Thanks for the advice.

+1 on that, as far as I remember 30over that's an 8 point ticket so you'll need one hell of a lawyer to talk it down to zero.
I know the feeling man but after 2 suspensions I don't leave home without my Valentine1. It works every time!

I think NYS allows for an arrest at speeds over 85 mph!

Somewhat, from what I understand violations are alerted to other state DMV's but it's at your home states discretion whether or not to assign points and record the violation.

For instance I have a NYS license and when I got a speeding ticket in NJ I just plead guilty and paid the fine. The points and violation never showed up on my NYS driving record and insurance did not get hit.

Unfortunately for the OP, it looks like NJ does record these violations, but only list it as an out of state violation that carries 2 points.

Per the NJ DMV website, it looks like you'll be getting hit with an out of state moving violation which carries a 2 point penalty. Better than the 5 it would have been in state.

IMO, you're better off just paying the fine unless you're highly confident that you can either beat the ticket or have it reduced to a non-moving violation. Considering your speed and what I assume was a speed limit of 55mph, it would be tough to make this happen. From the multiple tickets I've fought in NY, a violation like this would usually get dropped to a lower speeding violation or other moving violation, but not all the way to a non-moving one.

Thanks for the advice guys. My mother had gotten a ticket in the same area and got her ticket dropped to a parking ticket through a well known lawyer in that town. I'm going to get his opinion and then make my final decision. Wish me luck :/

I got a 93 in a 55 a year ago. I was attempting to get away from a douche in an E36 that tried to hit me twice in a span of about 30 seconds. The cop didnt believe me, so ticket. I had that reduced with a lawyer to a 2 point infraction of unsafely opening my door while changing lane without signaling (Its an on the book infraction in NYS apparently). GL with your ticket man.

Good thing they didn't add the aggrevating factor "while eating a banana on a Tuesday". That would have been a Class E felony! LOL
