So, I've contacted the other party's insurance company, but they refuse to accept any liability at the moment, despite clear evidence to my advantage.
What to do, what to do?

If their automotive insurance won't cover it, their business insurance will. As asiflicious says, get a lawyer. The longer this goes on, the more the other party (and/or their insurance company) has to lose. If I were a JD, I'd take this case on contingency in a heartbeat.

Well, got a letter (really?) saying they won't accept liability, and won't repair my car, even though their customer said it was their fault.
The other party said it was their fault. Their company still won't accept responsibility. Calling Geico now (my insurance), we'll see how this goes...

In RI we can get uninsured motorist insurance for a very small additional cost. A few years ago my wife's car was totaled by driver with no license and no insurance. Our uninsured motorist rider covered it.

Woo-hoo! Just dropped the car off, all will be fixed, and I will be happy, and my car will be happy, but Cincinnati Insurance won't be happy. Geico came to the rescue and will repair my car while they go after the other guys' insurance...
I'm really happy...despite not being able to drive my car for at least a week! 9 days until the 1-year anniversary of getting my car! I'll have to post some before and after pictures...

I got side swiped last month. Four lane highway, I was passing someone and when they were about out of my peripheral vision they decided to change lanes without looking. Very minor damage, no dents, but their front bumper contacted the center of my passenger door and scraped all the way back through the rear quarter panel.
Handicap plate, 75 year old driver, apologized and told me he was preoccupied taking his wife to the hospital. No police, no witnesses (stopped), no dash cam. Then I hear from their insurance company, the other driver claimed I side swiped him, so they have no liability! WTF. No one is honest anymore. I'm almost thinking of getting a dash cam, but my last accident was 30 years ago (when I was 16) and I've been driving in and around the greater Boston area in a BMW for the last 22 years without incident. |
