Inspection pass or fail - tire wear?
The dealer failed me on inspection for these tires. Thre place that put them on says they are OK...
What do you think?

I bought these brand new 8 months ago, drove my 128 from York PA to Seattle and back right away (almost half of the accumulated miles on the tires), and then did the normal commute from July till now. 21,500 miles on the car when I put the tires on, 29K after the trip, 36,900 miles on the car today. I'm a spirited driver but I don't trrack and I don't 'peel out' and squeal my tires.
The mileage seems a bit short to me. What do you think?

Its not only the tire thread depth in one spot on the tire. I think you have to have THREE tire ribs(channels) with at least your states minimum tread depth. Do you have that penny depth across three tread ribs or channel/groves?
You could contact your local State Police office. They are the ones who certify your local inspectors. Ask them what the law is... they will tell you. 15,400 miles is not too short of tire life - on a BMW with a sports suspension. Some only get ~8K miles. Some get more than 20K. Just depends on how you drive. Basically its normal to replace the rear tires TWICE for every front tire set. Just buy to rear tires and call it a day. You really do not want to be driving around on worn out tires like that when it rains or snow.

No, I agree. It's time for them to be replaced.
I went to Sears and the guy there was talking about 'adjusting' them... I thought he was crazy until I realized he was talking about discounting me on a 2nd pair because these didn't make it to anywhere near the tread life. It's never been about replacing the tires (that's a given seeing the pics) but more about maximizing my discount. Your analysis seems spot on; the fronts are at 6-7/32nds... so I guess I'd be best sticking with the same brand/model tires on the rear since the front ones are staying put? I'd prefer to look at something else given the wear but don't want to compromise safety, or, God forbid, handling! I can only imagine how often I'd replace 135 tires!

I've owned three 3-series cars with the factory sport suspension. While I put my share of highway miles on my cars (who doesn't in Texas?), I've never been able to get more than about 16K miles out of a set of rear tires because of the suspension settings, mostly the negative camber that is part of sport suspension. The worst I ever got was 8500 miles from some Yokos, and the best was Goodyear Eagle F1 GS-D3s. I'm on Conti DW now, and so is my wife's 128i, so we'll see how that goes - but both our cars have sport suspension. That, and my current 3-series is about to go away in favor of a 2013 335i, equipped with the dreaded runflats. I figure I'll let them wear out and then replace them with non-rft tires.

first picture, thumb nuckle = fail!!! I wouldnt risk them on my car. If they are close i always error on the side of caution. (mainly because it rains here a lot during the summer) I do not like boating in my 1
