2009 BMW 135i  [5.76]
Is it possible it's a dealer selling it and not private? Only photo's are from a dealer and it doesn't have number plates yet. Maybe someone defaulted on the purchase and they are wanting to make an extra $10k

This guys has been TRYING to sell it for a few weeks. Initially asking for offers over $114k (his cost). Now he (or she?) is asking for the highest offer.

Problem is that it seems to be that ORC are not included, by the fact that they are not mentioned anywhere, further there is the "*" that notes ORC are not included. Some one will buy it for sure. All I can say is.. 10% premium over what I paid, "tell him his dreamin".

Bugger it, I called the guy. Story is, he ordered it, put a deposit down, and now has had a change in financials, so can't go ahead. I said "you stand to make a profit on this". "Bloody oath", he replied, "try buy another one - you can't."

It's sitting at the dealership in Geelong for anyone who's interested, however all sales enquiries must go through the listed seller, as it's a private sale.

Interesting, if you haven't paid for the car, isn't it still owned by BMW? From what it seems, there is no legal ownership in favour of the guy so how can he actually sell it?

Hmm.....that doesn't make any sense....! So say you agree on the price of $120K. Who do you make the cheque out to? It wouldnt be to the private seller as he doesn't own the vehicle? If I'm buying a car from a private seller, the cheque always goes into the name of the registered owner. You're asking for trouble if you make a cheque out to a 3rd party selling on 'behalf' of someone else.

What's to stop someone going into Geelong BMW and settle a deal and they refund him his deposit?

Hmmm, you pay him -> he pays dealer and he takes the cream. Interesting that the dealer would let him keep it there without paying the full purchase price... someone (the dealer) will be paying for it to be in their floorplan cause BMW Aus will have sent them a bill for sure.


Either way that "bloody oath" attitude sucks considering he has the financial issue and can't afford the car (hahaha), instead he wants to sting someone else for his problem. BMW Aus should step in and take the car and RRP it at one of their Corp Dealers to someone who wants the car and has been in the queue for a long while.

With the attitude he's carrying, I can see him taking your cheque, telling BMW "Sorry, can't pay for the car so you can keep my deposit and list it for sale again" and him running off with your $$.

And you probably have little to no legal standing as you've made a cheque out to this individual assuming he's gonna pay the dealer.

LOL, I'm getting a bit paranoid and carried away- but a variant of this story happened to my mate and he got stung bad...

Offer the prick 90K and see what he says? IMHO the problem he is going to have is it is no longer a new car (forget registration) as he is the legal owner of the vehicle. He is liable to the dealership regardless of whether he sells it or not or has the cash or not, the dealer is well within their rights to sue him for the money.

Remember there is a big drop between new and second hand price, mind I am sure the dealer would probably offer to buy the car back and sell it 'like' a demo car

Since we're off topic - Project sounds cool. I still haven't decided which way to go yet - Alfa 105 Giulia, 2002tii or e9 3.0 csi. The Alfa is looking the most likely though I most want to do the E9.

I do know where there is a Tii roundy with all the bits if you are interested.

if and when mine sells i might be interested but i kinda want to get a cheap one (like 5-7k) and spend another 5-10k doing what i want to it... unless this one is shit hot and the owner wants max 15-17k for it...

there is a lovely E9 3.0 on carsales atm for like 27 i think.. in south australia.

i have been looking at alfa's too, but all the ones i have given a cursory glance look absolutely shagged/rusted out. its a shame really, they are such beautiful cars

From the sound of things it had settled. I am not sure if there's a clause on the contract when the buyer has to close the deal. Unless the seller is just going to be buying a cheaper car from the same dealership and some courtesy is extended to him to have the car that for the interest free period.
