...and the fact that Calaveras Road is a very tight road (you can't go faster than 40-45mph without things getting dangerous), it's not hard to believe that it kept up with what was most likely a stock E90.

Even IF this was tailgating, which I don't buy, this is a clear case of road rage and could land this guy in jail depending on the state. The BMW driver could have always pulled over and let the Mazda pass if he felt this was an unsafe situation.
