Another thing to add to the first post, if you have a UHF radio (walkie talkies), handheld or otherwise, please bring it. Makes it much easier to coordinate. For those of you with an extra one, it would be appreciated if you could bring them as well to loan to those who don't have one.

I'm OUT!!!
Regretfully, i have had to pull out of the upcoming drive day. The long arm of the law has caught up with me and slapped me with an $1800+ fine and '6' month licence suspension...
Damn you Adrian, i had only had the N55 tune for three days!!!!! Just opened her up for 300m to see what she could do on the M5 and they were just waiting for me!!! So I guess the only thing to do is accept my fate, has anybody contested a speeding fine before???? Any information that might help would be great!!!! |

I was a very naughty boy, 130km in an 80km zone... In Adrians defence , he has offered to take me with him to the drive day, but im not sure if i can handle being a passenger ....... I guess i will have more time to ponder my next mods!!!! Wash the car less frequently!!!! Maybe one of you gents might want to swing by and take me and my car for a spin ???? |

In terms of (b) Others have suggested that going 130km in an 80 zone does not fall into the definition of 'trivial', however, according to common law precedent in Walder v Hensler, the court is willing to accept cases where the offence is technical and there is no real risk of damage or injury resulting from your 'dangerous' driving. I believe your short squirt on the M5 falls into this category. Also, R v Nguyen places a STRONG emphasis for letting first time offenders off as a way of maintaining the reputation of a good character. You DEFINITELY should argue this point very vehemently if this is your first serious traffic offence. Being middle aged with a family or a spouse suggests that you are of a sound character and deserving to maintain a good reputation. Years of excellent civil service and clean criminal records DO count for something here. Again, your character references will be paramount to supporting the fact that you have an exemplary reputation that should not be tainted by a speeding offence such as this. In terms of (c) Again, the conditions in which you had a burst of speed can be considered by the judge. Say how you weren't watching your speed, lack of traffic made you lose sense of how fast you were going etc. Even mentioning that you had loud music at the time will help the judge understand your lapse in judgement. In terms of (d) I'm assuming you've had no previous serious traffic infringements or a criminal record - this is a very important point that must be brought to the judge's attention. You want to demonstrate that what you did was severely out of character and a momentary lapse of your otherwise law obliging lifestyle. Hopefully my limited legal knowledge is helpful in some way, but my advice is to hire a traffic lawyer (they're about $500 for local court appearances) and fight this bitch in court. You can EASILY reduce your 6 month suspension. I am willing to bet that you will get maximum ONE month at most. Quote:

ps: are you sure they were exactly 300m from the entry (assuming) before they pinged you? If you think it was less, refer to this thread: http://forum.e46fanatics.com/showthread.php?t=723106 (he's a lawyer and ended up getting a reasonable exemption)
