the kid who hit me said since FL is a no fault state, he doesnt have to pay a dime and my insurance company is going to have to pay, even though he got a ticket and it was legally stated that it was his fault, is what he said true?

That only prevents you from suing for personal injury. I'm pretty sure the car's damage is supposed to be covered by HIS insurance company tho.

The whole car insurance industry operates on the concept of fault, and without fault, it would be stupid for states to require you to purchase insurance. I think what's he getting at (and I'm not sure, since I've not looked at FL law) is that you can't sue him in tort--you can just recover the amount of money it takes to repair your car.

In other words (and again, I'm not sure, but it sounds kinda crazy) if you had broken your arm, or worse, died, you or yours couldn't sue him for those injuries. Just the out-of-pocket amount you spent on repairing your car.

Check here: http://www.iii.org/media/hottopics/insurance/nofault/ It's a good explaination about what no-fault means. Essentially it is his fault and his insurance company will be paying for it and his rates will go up. It just limits the lawsuit claims.

USAA is really great if you can get in. Normally you have to be a service member to join or someone in your immediate family has to be in the service. They have been really great with fast reliable service no matter where I get stationed. Better rates than Geico too! Does Geico give back part of your premium every year? USAA is owned by its members to often a distribution of premiums paid is allocated into a savings account. Just one of the great features that you get.
