Early Christmas present from Mr Rudd...

... well, blow me down like a feather! I checked the letter box this afternoon and found this:



Totally unexpected, I hadn't done anything to prompt it. I kind of was expecting it either as, although I'd ordered the 135i on the afternoon of budget night, I'd changed the order slightly and it was rewritten.

Apologies for the quality, couldn't be bothered using the decent camera.

The letter reads "Refund of overcharge of Luxury Car Tax on purchase if your motor car, detailed below, due to the 'budget night concession'. Your car was orderd before 7:30pm in the 13th May 2008".

Maybe I should buy a lotto ticket? :thumbup:

Congratulations Simon.

Mine was ordered 17 March way before budget night.

A couple of weeks ago I sent a copy of the legislation to my dealer together with a refund request. Nothing has happened and follow up calls have not been returned.

Now I can really put the pressure on.

I bought mine 4 weeks ago, does that mean I'll be in for the 'baby' bonus? I thought we were paying 33%?

Breville, if you ordered it before 7:30pm on the 13th of May, then you should receive the difference between the 25% and the new 33% LCT back.

Thanks Simon. Nah, I ordered mine 2 days before I bought it. How come you get the difference back then? Taxes go up; don't we just normally suffer that? Congrats to you though!!

It's a long story mate, there's a thread here about the LCT increase. In a nutshell, an amendment was made at the last minute to allow exemptions to tourism operators and farmers (or some such) and also for it to not apply if you'd ordered the vehicle before budget night. The last one is the only sensible bit of the whole thing. Totally unexpected and a nice surprise!

It was a proposed tax increase, which never went ahead in the end? So dealers were charging it to be safe.

Eh? I thought it went through. I def got charged 33% as I had the conversation with the dealer as they got notified the day I negotiated the deal. I'm going to call the finance guy tomorrow..

The tax went through. There were some amendments to the law that will enable people who ordered their cars before the budget was announced to receive the 8% increase in LCT back even though they took deliver after 30 June 08.

Threshold increase and amendments

Luxury car tax (LCT) applies to certain vehicles over the luxury car tax threshold ($57,180 for the 2008–09 year).

The Government announced in the 2008–09 Budget that it would increase the LCT rate from 25% to 33% from 1 July 2008.

Legislation to increase the LCT rate from 1 July 2008 became law on 3 October 2008, and includes a number of concessions:
  • In certain circumstances primary producers and tourist operators will be able to claim a refund of the additional 8% LCT (to a maximum of $3,000) on certain 4 wheel drive or all wheel drive vehicles
  • LCT will not apply to certain fuel efficient cars under the fuel efficient car limit ($75,000 for the 2008–09 year) from 3 October 2008, and
  • 25% LCT will apply to contracts entered into for purchases or imports of a luxury car before 7.30pm Australian Eastern Standard Time (AEST) on 13 May 2008 (the date of the Federal Budget announcement to increase the LCT rate).

Link isn't working...

Does "contracts entered into for purchases or imports of a luxury car" include placing an order with a deposit? I don't think I signed a contract of sale until the car arrived. None of us signed a proper contract until we took delivery did we?

I only signed the original an 'Offer to Purchase' on the 13th. I signed another, rewritten one, around the beginning of June when I added Nav, another when the LCT was announced (and I think when I paid the deposit) and there was a 4th new one when I went to pick up the car, but I was never asked to sign it.

So, I think the O2P is actually a contract. I seem to recall words to that effect on it. Anyway, why do you ask mate, your dealer not playing ball?

To be honest, I didn't think I had any chance of getting the refund due to the change I made in June, but every now and then you sink one.

Yee Haah... After I read your post Simon I bolted down to my office and found a cheque from AutoClassic for $1,782.89!!!

Dang..the wife's nicked it already!

BTW, I wouldn't call it an early present from Mr Rudd....he's the mongrel who wanted to whack us the extra 8% in the first place!!!!
