2010 tail light recall - DENIED!

My dealer told me they wont honor the recall on my faulty tail lights because they have been tinted! Although the tinting has absolutely nothing to do with the lights being faulty.
They actually said its BMW not the dealer. BMW will refuse the claim when they return the lenses to them!
Anybody else have this problem?

correcto mundo my dealer wouldnt take it back until the tint came off and i have an excellent rapport with mine, no way around that. if you sprayed them have fun scrubbing that shit off, it sticks like crazy!

Laquer thinner but not to much! Don't let it dwell on for to long.... Then use a decent paint polish to get them shiny again.

i think i might just pull the trigger on a set of LCI tail lights. there are like 500 sets of pre LCI tails on ebay but i know soon as i put one of them on they will fail as well!!!

I would contact your state's attorney general. This document seems to state everything the manufacturer must do in order to identify a problem, carry out a recall, etc. Nowhere does it say that they can deny specific customers while approving of others due to modifications on the car. Since it's a safety issue, they must fix it:

Also, the Magnusson Moss Act states that a dealership can't deny a warranty claim because of modifications if the dealership can't prove that the mods directly caused the problem. It is the burden of the dealership to prove your fault, and if they cannot, then they must fix your car. I know this doesn't apply to recalls, but if you argue your point that this is a safety issue, and if they can't prove that you caused the safety issue, then they must fix it. Probably won't work, but it's worth a try at least.

Acetone/nail polish remover also works in removing sprayed on tint. I was experimenting with mine and used it with no ill effects. But I didn't really let it dry more than a day

Just spent a few hours going back and forth... pretty much told me to suck it!

Honestly was quite surprised. i would think safety would trump all the other BS.

You can't really expect them to perform the recall if they're not going to get re-reimbursed for the parts/labor.

When you modify a part you should always safely assume you've taken responsibility for anything that goes wrong with it.

Never really understood why people want to tint their headlights and tail lights. I can barely see some retards brake lights and turn signals at night they tint it so dark. I understand the "murder" theme but the headlights and tail lights should be left out on the "theme" unless its show car that wont be driven on the public roads. Still they should fix it because there is a recall and I really dont see how tint on the tail lights can cause them to fail. I'd remove the tint and go to another dealer to get the fix, but do what you want.

Don't use that argument with them as it works more against you than for you. You put tint on something that relies on brightness for safety.

I would approach the matter with "hat in hand" at another dealership and see if that'll get you goodwilled under warranty.
