Its critical that you get advice and help from a present BMW owner, someone who is also an enthusiast, not just someone who has no interest other than status, looking good in a BMW.
Or, find a good BMW garage and ask them for help. You're going to have to take your car in for service/maintenance. Find your garage now rather than when something breaks. Have them do a pre-purchase inspection (PPI).
Maintenance records/work orders are also also critical so you know the car has been properly maintained.

Oh, and no difference between 40K and 60K really. It's all about proof that maintenance has been done. Cars you're looking at are now 8-10 years old. Owner should be able to supply proof of AT LEAST 10 to 15 oil changes.
