You will fail emissions with a catless downpipe unless you install a 'downpipe fix' temporarily for the test. They're around $100 but allow you to pass without having to revert every two years.
On the other side of the river I avoid emissions by just driving less than 6,000 a year. (The 135i isn't my daily) I just get a mileage exemption.
