The car you saw more likely than not had BMW NA or CA plates. And hence a research car - to test the waters for a hatch. Car makers can import a non compliant car for up to one year. Then they must export it OR crush it.

Or.... the car you saw could have been shipped into the US as a tourist. You can import a non compliance auto- so long as you post a bond and export it within a certain time frame. I think also a year max.

Btw.... Germany also has this same law. I have seen MANY American cars driver over here on US state( as in the various state) tags. I have seen a Grand Cherokee on Nevada tags, and a few cars with Florida tags. Again you got to export them before a certain time and also post a bond and pay some fees.
