If you're 90% sure that it's the low pressure fuel pump that's faulty and causes the problem then I'd fight it. It'd be easy for BMW to check that fuel pump and see if it's causing problem (I think). It'd be BS to blame O2 sim and SSTT mod to a low pressure fuel pump failure.
