Actually no, under these circumstances they are replacing the vehicle which would be their legal requirements, at least according to my understanding of CA law.

Good luck
Just received a phone call from the salesman at the dealership who helped to locate a car with me weeks ago. He said they had the car, and possibly have the paperwork finished by tomorrow, with a delivery date within the next week. Keep posted.

Thanks guys. Hopefully tomorrow I should have some official news from the dealership and an arrival date if everything goes smoothly.

My 1addicts sticker has been patiently waiting to get stuck on a car.

Keep posted.

Well, a spun bearing usually does not occur in a brand new car, so good luck and glad to hear all is working out.

I completely agree. Spun bearing was what BMW diagnosed. I have never heard of such a thing from a new car either. Thanks!

No new information today... No response to my follow up email from either the dealership or bmw corporate. Called the dealership and left a message with the general sales manager, asking him to respond to my email for information. Nothing yet.

Received an Email from the general manager at the dealership, informing me that BMW corporate had not secured a vehicle yet.

BMW corporate NA has informed me by email that they gave the ok for the dealership to acquire the vehicle, however the dealership is saying BMW hasn't acquired the vehicle at the other dealership yet.

So, the question then is, who acquires the vehicle? You guys have any idea?
seems like someone is giving you the runaround here... Have you consulted with an attorney yet?

My sister is an attorney.

I believe the hold up is at the dealership that they are attempting to acquire the vehicle from.

According to the general manager (dealership I purchased from) the other dealership that has the vehicle has not agreed yet, even though from my correspondence with BMW, BMW has already agreed to the vehicle. O, the drama!

Your patience is commendable. I know I would be on the phone with BMWNA everyday. Seems like people are dragging their feet.

I acquired it after a VERY long stay in the hospital from a motorcycle accident, haha.

Well, as of now, the dealership is saying the car they will acquire is the one being shipped to port. It is expected to arrive on 8 / 12 / 11. A week later then they originally said it would arrive. Keep posted, should hear something form BMW NA corporate tomorrow. But, that is where things are at currently.

Looks like it will be a 40 days and 40 night wait at this point.

I know that type of stay, too bad I can't say I remember what put me there.

Glad to hear your car is tentatively arriving. They should throw a copy of 40 days and 40 nights in for fun!

Sorry to hear about your accident as well.

Thanks! I am going to ask them to have a new copy of it waiting on the dash...Scratch that, would be even cooler if it was written in german and was under the plastic seat covering from the factory.

Big news today...

Received confirmation today, that BMW and the dealership has acquired the replacement vehicle and will be arriving to port on Aug 5th.

"your car is hitting the port from Germany on August 5th....we do our pre-delivery inspection. Then we can make arrangement's to do the collateral exchange document's..."

Appears that everything is finally going through, and should be able to put that fancy 1addict sticker on something in the next few weeks. Finally!!!

Keep posted!
