Did you check your NY state tax laws to ensure it would be double taxed? In CA, you can buy out a leased vehicle for resale and if you immediately resell it (within 10 days), you do not pay sales tax on the buyout. So in this case, you could exercise the contractual lease buy out option and then resell it to your brother. Only your brother would be required to pay the sales tax.

If it does result in double tax in NY, you might be able to exercise your contractual buyout (using your brother's money), and then once you receive the title in your name, do a transfer of title to a family member (i.e. your brother) for a very nominal fee. That's another option depending on NY tax/DMV rules.

Damn, you beat me to the punch Kouper as that's what I was going to write. I'm sure there's some provision to avoid the double tax if within a certain number of days, though NY has some crazy laws.

In CA, that tax only needs to be paid once, so you can either NOT pay it on the buyout price and when the new person within 10 days puts it in their name, they pay it, or if you pay it on the buyout, the new person doesn't need to pay any of that tax within 10 days.

The other option of course is if there's more than 6 months left on a lease, you can try to have them assume the lease. BMW won't let you do that within the last 6 months though.

Thanks very much for the advice! I'll talk to someone at the dealership to have my bro buy the car directly at my the lease end option price. If for some reason they don't cooperate, I'll buy it myself and investigate the quick turn around title transfer option.

My new whip is LeMans/Black/Blue stitch, 6MT, premium package, harman kardon, alarm, no tech. Sports exhaust is the biggest upgrade, and the original owner had swapped out the run flats with Michelin PSS's - much more forgiving over city potholes. And the blue instead of MG suits me.

Got it with 3K miles through CarMax, probably 12K off the original MSRP.

I know you didn't just say something bad about mineral grey. =P Sounds like those 313s started you down a dangerous path. They're a gateway drug.

Hi all -- been watching this thread with great interest. I test drove a 135is CPO and the m235i (in manual, to boot!), and I gotta say I like the way the 135is handles a lot better. Unfortunately I took too long to think about it, and the 135is was already sold. I'm now on a lookout for another 135is, but was wondering, what is a fair price for a 135is CPO at 30k miles or below? The dealership at which I test drove the vehicle listed it at $39k (with Nav , Premium package, and DCT), which seems rather steep. thanks!

You had us at you liked the 135is over the m235i. =P

$39k seems rather high for that many miles and while obviously it's hard to say what it should cost, i do occasionally look at the CPO listings on the BMW website and that $39k figure would be the highest they have right now I think. I think right now though most are $36k-$38k, but have seen some recently with 5-10k miles for about $39k-40k. Who knows what these things actually sell for, but compare to socal135's - 35k miles for $31k.

What kind of options/colors/etc. you looking for? I also imagine more and more CPOs will be coming up in the coming months cause the car has just barely been out for 3 years now, so first cars will be coming off leases. But with not that many cars out there, you may need to travel a bit to get the right one. Also, you can't really go off the BMWUSA listed CPO prices as for example, this one is listed on their site for a whopping $45k, but then when you go that dealer's site, it's really $39k.

Haha -- yeah I was surprised myself when I test drove both cars back to back. The m235i just didn't feel as connected as the 135is, and I really love the DCT (didn't think I would since I really wanted a manual).

It seems to me that $35k is reasonable but I may have to wait awhile for the right one to come up again in my neck of the wood.

I had same feeling after I drove one at Kuni BMW. The transmission was ok, but not as crisp as the DCT and the car felt numb and disconnected. I didn't realize at the time OF the drive, but realized later it was likely the lack of steering feel that made everything so numb and unengaging. Never been so bored in my life on a test drive.

How many of you all seriously think that you'll keep the car for a serious long haul? (the next 10+ years)

I'm really on the fence. Though 10+ years is way too much for me. 5-7 years for me would be "long haul."

Too many factors for me personally to try to accurately predict, as much as I'd like to try to figure this out as it impacts what I do to/with the car now. But in an ideal world, I would try hang onto it even if I did get a new car at some point down the road. May not make much financial sense to do that, but I will know more this weekend as I'm going to probably go drive a few special new offerings, see if they do anything for me. If they don't, then tack on a couple of additional years for me and perhaps a second car to boot.

Greg! What are you writing about? Last I checked, a used 135is with 30,000 miles was going for $45,000ish about $10,000 less the the 1M.

If there are no new cars that will interest me 5 years from now, I'll probably just hop on into modding the car. This is assuming when I get to buy my dream car, CLK 63 AMG BS and/or a Lotus Esprit V8 (ideally a sport 350). Either way, the plan is to keep it forever and ever even when it's dead.

yeah i think mid to upper $30s is the right price for a 135is under 30k miles. Mine was resold after trade in for around $38-39k CERTIFIED with 19k miles last July. MSRP on my car was almost $51k. It's nice to see the prices haven't fallen much since last July though as i see most of the 135is for sale are still around $35-37k which is good.

I think the 'secret' is sort of out that the 135is is a much more enjoyable car to drive than the 2-series. lol.

So BMW's best marketing tool for the 135is was coming out with the 2-series. Thanks BMW. =)

Just wish the 2-series active tourer was coming to to the US for you. =..(
