I'm really enjoying all the posters coming in here and saying that you have to inspect the items at pickup and if they don't work when you get home it's too bad for you, you should have inspected them better and detected any problems.
I don't know what country you live in but in America we have laws against Fraud. Remember the black van scams a few years back with guys selling counterfeit speakers out of the back of their trucks claiming they were worth thousands of dollars. Of course that was a situation where the buyer should have totally inspected the product first and figured out they were fakes. So everyone who bought one was at fault... LOL, of course not...that was crazy illegal people go to jail for stuff like that everyday. There's no rule about inspecting products at pickup in business law. Pinmagic is correct you need to have a bill of sale in which both parties agree to sell and accept products as/is but even then certain conditions can void those contracts. Matt and I had no such bill of sale and our agreement consisted of text messages which outlined what items would be sold to me. I just really can't believe some people would think that cheating someone else or misleading or selling them items not as described is 'OK' as long as the person can't figure it out at pickup. That's really the dumbest thing I have ever heard. |

While I agree with buyer beware, the only scamming going on involves misrepresentation of the product. Calling Fumus a scammer is over the top (and factually incorrect, if we can take both sides as accurate). I'd much rather deal with Fumus in the future and we will remember to stay away from M///1rider.
I once bought a set of rims on this board from someone who had moved away. A shop had the rims, but I had to pay him first before he would agree to release them to me (only a hour away, but not worth driving down just to look at them). We had a gentleman's agreement that if he had misrepresented the condition of the rims and tires in any way, I could refuse to pick them up after inspecting them and he would refund my money, no questions asked. The wheels were as represented, so no problems. Personally I don't see how folks can sell dirty rims. I would clean the backs of them so you could do a proper inspection. You know what you are selling and they would photograph better and probably command a better price. That said, I hate these type of threads too, and wish Matt and Ryan could have reached some compromise. |

I hate to see these sorts of stories, because it makes me even more hesitant to purchase items from people on these boards. I see both sides. Both parties are making valid points. I sympathize more with Fumus though. It's not how good of a deal Fumus got, it's about the product not being as described by Matt. If the seller sold the rims advising that only 1 rim was cracked but in actuality two were cracked the sale should be amended.... My take away - have it put in writing that if product is not as advertised a full refund would be issued; that or have the seller provide you with a written inspection from a shop advising that the product is indeed sound.

Which tire was that that had the side wall damage?!
I originally purchased the two Dunlops that were for sale http://www.1addicts.com/forums/showthread.php?t=646348 after they did not ship I asked for a refund. Matt straightened things out but the communication was spotty and took a few weeks. I thought he might have been taking the $ and running but I did eventually get the funds returned...kinda sux, I really wanted those star-specs. With regards to the rims or any other product, if the seller knows of any faults, damage, what have you, he or she should inform the buyer. That being said, people don't always do that which is why paypal has the protection. It would be easy for either party to abuse it. At the end of the day, doing the moral thing saves everyone time, money, and aggravation. Those wheels have a warranty against cracking.

I have to side with Fumus on this. This forum is a community of like minded folks who are here to share their love of the one. Part of that love is the experience of buying selling aftermarket wheels and other fast goodies for the car. To screw someone by selling them damaged goods is just plain shitty, especially knowing more than he let on and what was actually disclosed. That's not cool, just from the standpoint of being a decent and honest human being. I am glad Fumus used paypal and got some of his dough back. 1M rider knew his goods were not up to snuff, and to use price as an excuse is lame and petty.

I’m with FUMUS on this one. You guys saying he should have inspected them because that’s what you are supposed to do, would it be different if the items were shipped and not picked up? No, it would still be up to the seller to describe the item accurately. Selling an item dirty as hell is shady enough in itself. Who does that.

Listen i do not check this forum.
I have dealt with many people on this forum buying and selling things. When you picked them up the rims were fine i do not know what you did with them since they left my possesion. Even after all this just to shut you up i will still offer a full refund which i did bwfore. It sketchy to have someone not refund the product if they are so truthful with what they have found. PLEASE return the product and you will recieve a full refund. |
