Affirmative: different design of the middle three fins/notches + indent is OEM. Below some pictures (June 2011 build). Small black triangles at the bottom of some fins/notches: tell-tale signs of the "love story" between front tires and fender liners...

Actually, so far no clarity about that. Anyway, as for now, the heat gun might be your 1M's clearance friend (but do handle with care). At least resolved the clearance issue on mine.

Below two pictures posted on the German 1M forum (the second picture is of an early 2012 build 1M). Do you see any difference in design and/or mounting ?

Anyone in the US have this change made?

I am noticing a rub when turning to the left (mostly when backing up) in the front right fender. I have not noticed the left front fender rubbing. Not only is this annoying (least of my concerns) but I don't want to mess up the fender liner or the tire!

As quoted above, a German 1M owner reported (Apr 14, 2012) that his 1M front fender liners were replaced upon initiative of his dealership (he visited his dealership for another reason and they spontaneously raised the topic themselves):
"I visited my dealer for another reason.
There I was informed, without [my] request, that the front fender liners must be replaced. Info from BMW. Upon query for the reason [of the replacement] the answer was something along the lines of «rubbing of the front wheels against the fender liners at full lock during reverse driving»".

So if you experienced/noticed fender liner rubbing (check especially the front right), then keep your ears and eyes open during your next 1M service visit to the dealership. It might be that they raise the issue before you do.

Here's a take on the issue, via two pictures of stock 1M wheels and tires, by a Belgian bimmer forum member (Andra): the "indent zone" of the fender liner should be sitting a little lower, more particularly in the tire versus fender liner "contact zone" (source: http://www.bimmerboard.be/forum/inde...opic=26797.315). Seems to make sense IMHO.

Furthermore, he correctly pointed out that rubbing tires can be a reason to fail a pass at the motor vehicle inspection in Belgium.

Maybe this is BMW's way of telling us that we must lower our cars. We need to make the touch zone fall into the indent after all.

Actually, it could make sense what you jokingly commented: it ain't excluded that the 1M was sitting a little lower in the fenders during development (no contact tire versus fender line due to compliant indent height), but suspension was fine-tuned a little higher in the final stages of the 1M development (more ground clearance). Fast development, as we all know. Consequence: rubbing due to a lower sitting "contact zone" ("indent zone" located a little too high) = compliance issue.

Mine is lowered(HR sport) and no rubbing, but very little clearance!

I had my front liners changed today under warranty.
The parts have the same code but no changes in the moulding form or mountings.
So bottomline much a do for nothing.

But I have some other serious probs. The upper and back liners at the front wheels showed some major holes due to wheelrubbing. I think this could be related to tracktime @ Spa. I've noticed a hole in the left wheel liner whereas there was none on the right side and Spa track has more right curvers/corners.

Be careful, tire rubbing could lead to tire failure. I was in a car on the track with serious tire rubbing and we had no idea.

One lap after I got out the tire blew (120mph+) and the car slammed into the outside wall of a large banked curve , driver almost saved it.
