Need some help determining a part E88

Hi, I've been having some water leaking issues and upon a closer inspection noticed there is a gap in the 2 piece gasket connection on my passenger side compared to the driver side. I'm having trouble figuring out if this is the right part and need another set of eyes:

Just in case someone else running into the same issue. I went to a dealer and they determined the part that needs to be replaced is 54347174784. Now the question is I'm out of warranty but I complained about the leaking twice before it ended. The dealership says they might be able to get BMW to goodwill some or all of the repair ($620, parts, labour and taxes) but they need me to pay first. Has anyone successfully gotten BMW to goodwill a service? Thanks

I've gotten BMW to goodwill my 3rd brake light (it's been to the dealer 6 (SIX) times to get it repaired so far, I guess they didn't follow the SIB correctly the first 5 times).
