BMW DME Software Questions

I did search on this first of all, and maybe I am just retarded but searching for "ecu software" didnt really come up with many relevant results.

I beleive I've got the software where the wastegate fix was put in place (and therefore introduced a fair amount of lag.

My questions are
1) I recall reading this was potentially fixed in new software.... is this true? Can the software be requested to have installed or will bmw not install unless there is an actual problem?

2)is there an easy way to tell exactly what version of software my car is running?

All I have done with my car is bmw performance exhaust... just seems to hesitate a bit down real low... I'd say my car is definately not making full tq by 1500-1700rpms which I thought it should be ready to roll by then.
