I will do just that, i just wrote to him explaining how even my local dealer read all the modules in the vehicle, which means technically from his terms and conditions they should also receive payment.

I made it clear to him, that i contacted him on several occasions, asking for any changes possible since i was not satisfied and felt something was off, he just replied very rudely. Even then i never accused his software as "bad" or "terrible" in anyway. I informed him that we can ignore this little game and go about our lives, since i did contact him first several times about the issue and left me no other choice. Or if he wants to, send me the bill and i will take it to a lawyer and to BMW and let them deal with you directly, since i want nothing to do with this topic, lets see the reply.

I reported my experience, how i swapped tunes and that i am very happy and satisfied how the engine is now, the 1st tuner came into the picture.

He claims i "violated" an agreement, he copied and pasted a condition from his website, stating that any means of reading, downloading, copying or distributing "his" software tune is a violation, and that all parties involved must pay a fine of €5,000.

Personally, i never saw that agreement on his website, till he posted it today, and no way to prove otherwise. Also the invoice i received has his stamp and signature but not mine and that term/condition is not mentioned.

I also find this very silly and annoying, which shows how a "one man show" tuner likes to run his business. So if i got a tune from the USA and they asked to read what is on my ECU, would that tuner abroad be forced to pay? I took my car to the dealership and they read the ECU as well, should they also pay for this?

It is rubbish like that, that really makes me wonder what the hell is wrong with the tuning scene in Germany. I could ignore everything, and if he sends me an invoice i could also ignore it. But if the issue blows up, which it always could, i can fight against this somehow.

I never attacked him or called his tune bad, just that i was not fully satisfied and wanted something more or a second opinion. For him to come out of the blue and jump in like this frustrates me.
Just seeing this now but wow this guy is out of bounds. If there was no acceptance of terms and conditions then not only does he have no claim to make but this also makes him both dumb and an asshole. No business-savvy individual would fault their constituents for not liking their products, that's just a terrible way to say, "we suck, you paid for it, too bad.".

Also German courts require an agreement from both parties, this is standard in most countries' laws.

I'm way too ballsy (not a great thing in some cases lol) so I'd probably screenshot this whole ordeal and post about it to warn future purchasers of his products.

Passed by the local dealership, picked up 2 liters of MTF-LT3.

I was going for the Ravenol MTF-3, but i could not find the new BMW approval/number on it (it had 3 BMW part numbers). So i decided to get the original instead.

Past by the DIY shop, the lift was free, 30 minutes later the oil was replaced.

Shifts a lot smoother now, still has a slight notchyness to it, like your typical BMW shifter, but much better than before.

Going from Castrol Multitrans 75w-90 to Castrol B75w to original MTF-LT3, i just hope that i did not cause any issues internally. Could not detect and metal shavings in the old fluid.

Matticus91 yes! I keep power washing in there to finally peel the floor off so I can have an excuse to do properly

Plus it's been in the high 90s lately so I keep in the shade inside the garage. Just need to make sure I point well so I don't blast all the stuff I have hanging on the walls!

The 1's together would have been nice to get pics of but I was helping run the BMWCCA tent so had no time to gather them all together for a pic. Next time I will.

I'm late with this post, but I took my 128i to the track on Saturday. I ended up getting sick on Friday with a cold, so it put a damper on the day, but in all it was a good day. The track is a 1.7 mile track outside DFW called Motorsport Ranch. It's not a terribly fast track, top speed was maybe 100mph. I never shifted once, just kept it in 3rd gear the whole time. In my fastest session, I was hitting redline at the end of both longer straights.

This was my first time on track in 2 years, and first time with the 1er since 2015. Last time the car was completely stock down to the runflats. This time I had Eibach pro-kit springs, Koni yellows, M3 front arms, Whiteline 2-piece RSFBs and Dinan camber plates. Tires are Falken Azenis 615K+, 225 square on factory sport wheels. This setup was very balanced. I didn't notice understeer anywhere on track, though I'm also not driving the car to its limits so we will see if this setup needs to be tweaked. There are 2 quick right-left sequences on this track, and the car felt incredible through them. I did not really think about it until writing this post, but the RSFBs are supposed to help with transitions so I guess they did their job.

It is really funny to see the variety of cars that show up to track days. There were 2 new Vipers, a Hellcat, 2 GT350s, and about a million C5-C7 Corvettes. So mostly high-horsepower cars. Then an Alfa 4C, me, and a few Miatas. My instructor kept saying "now give it full power"... dude, my foot has been to the floor since the apex! This is all she's got! More power would be fun but I feel a lower horsepower car helps you focus on your line and what the car is doing. I learned a ton in my 116hp Miata and expect to learn a lot with the 128i before moving up to something quicker.

The huge bummer of the weekend is that my car keeps going into limp mode. The first couple of sessions I was learning the track and got all the way to the white flag before it hit. By my last session, I only got 5 laps in before it cut power. Since this was a 2-day event, I was scrambling Saturday night to try to get NCS Expert working to code out the brake heat calculator ("FLR") but I couldn't get it. Between that and being sick, I skipped Sunday.

Finally wore out the runflats that had just been put on the car when I bought it and replaced them with a set of the Firestone Indy 500's. Took the opportunity to also have my newly refinished Style 71 wheels put on (details here https://www.1addicts.com/forums/show...6#post23732606).
I'm digging the new look!

Refinishing job turned out nicely.

The 71s are definitely different, in a good way.

I think they look great on your car!

Already done and i am ignoring him completely, if anything comes î will call him and try to resolve the issue first. I do not think anything will come, but i am completely ignoring it now, since i never signed such an agreement.

I am focusing on other things, such as the car. M3 arms, RSFB, LSD, diff mounts etc. Hell i am even looking at 335i front calipers w/Z4 2 piece discs and 330i rear calipers (larger diameter piston) and what not. Not letting someone like him ruin my enjoyment of owning the E82.^

Wondering if the 335i calipers/discs up front require a TÜV approval or not as well.

I am loving the tone on it, did a cold start after a few hundred miles on it and the car has a deep sound almost comparable to the M2 setup I had. It was also non resonates setup but it was a high flow Cat rather than Catless like this one.
I don't really get any drone to speak of. I eliminate it by not letting the RPMs dip too low when cruising. Heard several people complain about drone with the PE. That has always taken care of it for me.

Edit: will adjust my driving habits to see if the damper makes a difference on its own and let you know what I find out.
Took my 1er out last night for a midnight drive. Mostly went out at that time because I knew it would be pretty quiet so I could hear my car.

Drove in total auto mode with no sport button pressed so the DCT would go all the way up to 7th gear at low RPMs. Didn't notice any difference with the vibration absorber, but admittedly, don't drive that way very often.

There was some drone, as I'm pretty sure there was drone when driving the same way before installing the vibration absorber, but as I said, I hardly drive that way.

I didn't forget either, Ban.

Not sure if I'll keep it, but put an N55 badge on the grill. Seems like it'll be convenient, because people are always asking at club events which engine I have, and the rear of the car is debadged (because of the stripe.) lol
