135i vs. Tractor Trailer

I-93 South in Wilmington, MA

4 lanes, rush hour, I was in the far right lane, doing ~40 mph following flow of traffic.

Tractor trailer was coming up on my left and moved over on me. Hit my rear wheel pretty hard, I was pitched sideways, counter steered and pulled over. My rear wheel now has camber. Just put in new Koni Sports last week. (Bonus: The NLA Performance side skirts appear undamaged).

The (Canadian) driver pulls over and gets out and sheepishly tells me he didn't see me. Thankfully he told the State Police the same thing.

Good about the side skirt. They're becoming more desired than mudflaps these days. lol

It would be nice if your other new wheel was a rear as well (probably isn't), because then you'd have a replacement for your newly damaged one, assuming you have a staggered setup like most 135i's. Insurance should take care of it, anyway. Haven't looked recently but I believe the 261Ms are still available.

Is there any damage other than what we see in the pic?

That sucks but on the bright side, engagements with cars and tractors often have far different outcomes for the car and it’s passengers. Consider yourself very fortunate and get it fixed.

I'm glad you weren't hurt and the truck driver stopped. Cars are fixable - but it's a significant hassle.

Looks like it's going to be totaled. With the suspension damage, it's at $9K and counting.

I bought the car under 4K miles with the following already installed (I have the receipts for parts and labor). I paid about $5-$6K over a similar year/mileage stock CPO:

BMW Performance Exhaust
BMW Performance Power Kit (Stage 2)
BMW Performance Suspension
BMW Performance Short Shift Kit
BMW Performance Side Skirts
BMW Performance Electronic Steering Wheel

I added:
BMW Performance Emergency Brake
BMW LCI Tail lights
BMW Rear and Side Sunshades
BMW Stainless Steel Pedal Set
BMW Wide Angle Blind spot mirrors (euro)
Koni Sport shocks (2 weeks old)

And the body/interior is mint, almost 10/10, so the car is worth more to me than book value.

Will insurance settlements take into account things that I have receipts for, even if many years old?

Any advice appreciated -- never had an accident (except some minor stuff that was well under $1K to fix out of pocket).

Glad you're ok. At least the driver fessed up.
That really sucks if they are going to total it. Sorry, I have little experience in this. MA insurance can also be different than a lot of other states too.

While I deal with injuries, property damage I rarely see. From what I do see (from the insured's side) is that the Ins. company won't give you much credit if any for the upgrades. Maybe the shocks because they're relatively new. The other parts 10 to 20 cents on the dollar if at all. The usual offer will be low KBB, ask for replacement cost: like for like. Some people take the buy back money and part out the car for more, but that takes time and space to keep it. I usually tell people to get an attorney for personal injury, some will help out on property damage, majority will not. I hope this helps some. BTW, thanks for the cargo hooks.

Yup, and never take the first offer. You can always negotiate.

Also, as said, remove everything you can before turning it over.

You'll have to negotiate with the insurance company. When my 06 Focus was totaled after hitting a deer, I had to negotiate with my insurance company, State Farm. Unfortunately, I threw out the stock head unit and had a pretty decent Pioneer one installed. State Farm said I couldn't remove the Pioneer head unit unless I installed the stock one back in. After going back and forth for a little bit, State Farm agreed to pay me for the Pioneer head unit. If I recall correctly, they paid $300 which was about 2/3 to 3/4 the price I paid for it. What ever the payout was for the head unit, I do remember it was reasonable for the amount of time I've had it.

So that's the issue you're going to run in to. If you want to pull the aftermarket parts to sell on your own, you have to have the stock pieces available to install in their place. Something such as the sun shades, I'd be you can just pull those and they wouldn't know or care. But if you pull the Koni's and don't install something in their place, you bet the insurance company is going to have an issue.

Here are steps to take
  1. See if you can replace the car in its stock form with the offer. If yes, take it and be done. If no,
  2. Review the appraisal.
  3. Make sure they are using comparable cars with similar miles
  4. if not prepare your own appraisal and fight
  5. If you aren't getting paid for your "upgrades" take them off. I have stock 128i shocks and springs with 50,000 miles on a shelf. One strut has the spring mounted, the other needs to be compressed. Im in CO.
Also, look into buying it back and getting it fixed. If you plan on driving it for a few more years you may be able to pocket some $$ and live with a salvage title. Document the damage in case you do want to sell it.

Also, a lot has to do with which Ins. Co. your dealing with and the claims adjuster. Some are easier to work with than others.

Update: Took a month, but after negotiating with insurance company they came up $4300 over their initial offer low ball, which was acceptable to me. Trying to get them to go higher was not worth my time/effort.

I had already bought a replacement vehicle (in signature), so I was willing to take all the time required for something that was fair.
