Gasket with those spring bolts should work just fine.

So the exhaust is on sounds little better but not a huge difference, also that gasket was a bastard to fit! And for a cruel twist of fate the guy I purchased the exhaust from now has a y pipe as well, 100 pounds later and I've ordered the y pipe. I'll fit the y pipe around Christmas time I think and see how it goes with just the back box for now

That depends on your cutting skills... hah. But basically, yes, it's kind of hidden up in a channel of sorts under the car, I can't imagine doing it while still on the car. It might hang enough from the front to get some clearance but I'd be cautious.

(I have the PE, I didn't install it, but I have had to replace the clamps, so I'm going on memory from that).

Sorry chaps do any of you have measurements for the clamps? specifically the internal diameter? i think i have some that will work without having to buy the extortionate ones from BMW.

One of Dack's pictures above shows the number of the clamp that comes w/ the kit. At a minimum that should be enough to tell you the size. Plenty of other vendors will sell them as well, or something equivalent.
