If you really want to sell the items as is, and be legally free of recourse by the buyer, the safest thing to do is have a bill of sale that specifically states the items are sold AS IS, WHERE IS. Short of that, you may have some legal responsibility to ensure they're as represented and/or fit for the use intended.

I can see both sides here, tho I'm not sure the OP was as clear with the facts as he could have been.

BTW: I recently had a similar situation with a seller here. We were able to work it out with a compromise.

I'm really enjoying all the posters coming in here and saying that you have to inspect the items at pickup and if they don't work when you get home it's too bad for you, you should have inspected them better and detected any problems.

I don't know what country you live in but in America we have laws against Fraud. Remember the black van scams a few years back with guys selling counterfeit speakers out of the back of their trucks claiming they were worth thousands of dollars. Of course that was a situation where the buyer should have totally inspected the product first and figured out they were fakes. So everyone who bought one was at fault... LOL, of course not...that was crazy illegal people go to jail for stuff like that everyday.

There's no rule about inspecting products at pickup in business law. Pinmagic is correct you need to have a bill of sale in which both parties agree to sell and accept products as/is but even then certain conditions can void those contracts. Matt and I had no such bill of sale and our agreement consisted of text messages which outlined what items would be sold to me.

I just really can't believe some people would think that cheating someone else or misleading or selling them items not as described is 'OK' as long as the person can't figure it out at pickup. That's really the dumbest thing I have ever heard.

While I agree with buyer beware, the only scamming going on involves misrepresentation of the product. Calling Fumus a scammer is over the top (and factually incorrect, if we can take both sides as accurate). I'd much rather deal with Fumus in the future and we will remember to stay away from M///1rider.

I once bought a set of rims on this board from someone who had moved away. A shop had the rims, but I had to pay him first before he would agree to release them to me (only a hour away, but not worth driving down just to look at them). We had a gentleman's agreement that if he had misrepresented the condition of the rims and tires in any way, I could refuse to pick them up after inspecting them and he would refund my money, no questions asked. The wheels were as represented, so no problems.

Personally I don't see how folks can sell dirty rims. I would clean the backs of them so you could do a proper inspection. You know what you are selling and they would photograph better and probably command a better price.


That said, I hate these type of threads too, and wish Matt and Ryan could have reached some compromise.

I hate to see these sorts of stories, because it makes me even more hesitant to purchase items from people on these boards. I see both sides. Both parties are making valid points. I sympathize more with Fumus though. It's not how good of a deal Fumus got, it's about the product not being as described by Matt. If the seller sold the rims advising that only 1 rim was cracked but in actuality two were cracked the sale should be amended.... My take away - have it put in writing that if product is not as advertised a full refund would be issued; that or have the seller provide you with a written inspection from a shop advising that the product is indeed sound.

Which tire was that that had the side wall damage?!

I originally purchased the two Dunlops that were for sale http://www.1addicts.com/forums/showthread.php?t=646348 after they did not ship I asked for a refund. Matt straightened things out but the communication was spotty and took a few weeks. I thought he might have been taking the $ and running but I did eventually get the funds returned...kinda sux, I really wanted those star-specs.

With regards to the rims or any other product, if the seller knows of any faults, damage, what have you, he or she should inform the buyer. That being said, people don't always do that which is why paypal has the protection. It would be easy for either party to abuse it. At the end of the day, doing the moral thing saves everyone time, money, and aggravation.

Those wheels have a warranty against cracking.

One of the Hankooks (for the front) had sidewall damage which caused a rather large bubble to form when the tire was inflated(if check back to my first post, I uploaded a picture of it). Again, when I purchased the wheels/tire set Matt had deflated the front two tires(but left them on the wheels), he left the back two inflated...I didn't think anything of it at the time but I can see now it was because he wanted to hide the damage to the tire.

It was just the icing on the top of the cake, not only did I receive an additional cracked rim which Matt would take no responsibility for or offer any sort of compensation...but after I purchase 2 more wheels and try to get them mounted on the car....SUPRISE! Now I have to buy another tire too.

Anyone else notice how quiet Matt has been once I started to tell my side of the story? Maybe, he should change the title of this thread to something more fitting...like Warning-scammer M///1rider.

Personally, i side more with Fumus than M///1rider. If i were selling wheels, i would make sure they are clean and fully inspected before putting them up for sale. Putting them up for sale in half ass condition is just asking for problems.

I have to side with Fumus on this. This forum is a community of like minded folks who are here to share their love of the one. Part of that love is the experience of buying selling aftermarket wheels and other fast goodies for the car. To screw someone by selling them damaged goods is just plain shitty, especially knowing more than he let on and what was actually disclosed. That's not cool, just from the standpoint of being a decent and honest human being. I am glad Fumus used paypal and got some of his dough back. 1M rider knew his goods were not up to snuff, and to use price as an excuse is lame and petty.

I’m with FUMUS on this one. You guys saying he should have inspected them because that’s what you are supposed to do, would it be different if the items were shipped and not picked up? No, it would still be up to the seller to describe the item accurately. Selling an item dirty as hell is shady enough in itself. Who does that.

After I contacted Matt about the tires and he indicated via Private Message and Text Message that he had 4 wheels for sale as well as another two tires. He told me that he had inspected the wheels and stated that one was broken. He offered the whole set of 4 tires and 4 wheels (1 broken) for $700. I drove 2.5hrs and picked the wheels and tires up from Matt in NJ on Saturday April 21st and upon initial inspection they appeared "OK".

After I got home that day and cleaned all the dirt and soot off of the wheels I realized that an additional wheel was cracked. I sent a text message to Matt and asked for some kind of a refund to compensate me for the cracked wheel, he stated that even with two cracked wheels I still had received a good deal. I had the second cracked wheel Matt sold me inspected by a wheel repair specialist at AWRS and he told me it would cost $150 to fix it but that it was so badly damaged he couldn't vouch for the safety of the wheel and recommended I buy a brand new one.

Matt's resolution to my problem was that I should pay to ship/drive the entire lot of wheels and tires back to him 2.5hrs. The cost of driving or shipping would have negated any sort of benefit to me(as it was I had driven 2.5hrs to pick them up), quite the opposite it would have put me at a loss of about $100+. So, at that point I opened a paypal dispute and went about trying to buy another two wheels for my car.

Last week I went to go get the tires/wheels mounted, it turned out that one of the tires that Matt sold me had bubble(side wall damage) and was unsafe to drive on. I thought it was curious that Matt had sold me the two front wheels deflated, while the two back ones were fully inflated and ready to go. Now I know why, on top of the additional crack rim he sold me, he also sold me a broken tire.


BUYER BEWARE OF ///MRider.

My intention was never scam to anyone. I made a deal which was for 3 wheels and 4 tires at price of $700. What I actually purchased was 2 wheels and 3 tires. Matt's response to all of this was that I had received "such a good deal" and when he purchased all of this stuff way back when it was worth several grand. He didn't deliver to me, what I paid for. I gave him the amount we agreed upon...I should have received the goods we agreed upon.

Initially I just asked him for $100 back to compensate me which, I thought this was more than fair...he refused to admit any wrong or offer any type of compromise(besides me spending additional time/money returning them to him in NJ) so now I am waiting to see what Paypal/Credit Card company will do for me. I'm glad I went through paypal...had I paid cash I would be out the entire $700.

Attached are pictures of the two cracked wheels Matt sold me taken the day I got them and a picture of the damaged tire taken last week.
The tires and rims were not mounted because i wasnt paying out of my pocket to get them mounted.

The tires were in perfect condition when i took them off my last car. I cannot take the tires off the rims myself that makes no sense.

The rims and tires were sitting in my garage.

They were taking off the rims ever since i got them taken off the car two years ago.

Ok - that's your choice not to do business with me. As I said I have had only pleasant transactions here on the forum, this is the only one that went poorly. It's my right as a buyer to dispute transactions when I feel the seller has not delivered what they promised. It wasn't as if I went home and discovered the wheels were the wrong size or they had some cosmetic defects. The cracked wheels and the damaged tire rendered them useless.

I'm also glad to see that you would have been reasonable in a situation when you sold a buyer damaged goods.

Well, 2.5 hours is more about what it would have taken to return the goods. In essence it was that or ship it back. What would be the benefit to me? Shipping them back at my expense was a lose/lose situation. I'm not whining about anything, I didn't start a thread. I'm just telling my side.

In any case, I don't need to win in the court of public opinion, I don't care if posters here think I'm wrong, I already won the paypal battle...I'm getting my money back. If you don't want to deal with stuff like this, don't sell people damaged goods and don't mislead buyers. Simple as that.
Return the product i will give you your full money back.

Believe me i have never had a problem selling anything.


I installed an intake for you right on the spot and also sold you a 1M shift knob.


Please send the product back so i do not have to deal with this anymore.

The rims were clean this is insane.

I cleaned the rims myself with a microfiber towel. Sent over 30 pictures of the rims as well.

Because my life doesnt revolve around sitting on an internet forum?

For all i know he could have damaged the rims himself.

How do you know he did not recieve the rims and damage them at his house?

Listen i do not check this forum.


I have dealt with many people on this forum buying and selling things.


When you picked them up the rims were fine i do not know what you did with them since they left my possesion.


Even after all this just to shut you up i will still offer a full refund which i did bwfore.


It sketchy to have someone not refund the product if they are so truthful with what they have found.




PLEASE return the product and you will recieve a full refund.
