Even people at BMW crash...
http://www.sacbee.com/ourregion/stor...Our%2520Region
Two men are safe, but a new BMW automobile is not after it flipped onto the train tracks in Davis and an Amtrak train totaled it. The crash occurred about 9:24 p.m. Tuesday near the intersection of L and 2nd streets on the east side of downtown Davis, said Davis police Sgt. Rod Rifredi. Aaron Singerenglar, 25, of Redwood City was driving the 2008 BMW 1 Series and failed to negotiate the "very sharp 90 degree turn," according to Rifredi who also said crashes are not uncommon at the site. "The gentleman was heading into the turn a little too fast," Rifredi said. The car flipped onto the train tracks and Singerenglar and his passenger, Peter Dempster, 26, of Davis, escaped before an Amtrak train hit the car moments later, destroying it. The two men suffered minor injuries from the initial crash, Rifredi said. Alcohol and drugs are not believed to be a factor. The car is owned by BMW of America. Singerenglar works for BMW, Rifredi said. A Davis police investigation continues. |

LOL
that turn is a bitch. i went through that turn too fast once and got stuck on the rail road tracks. theres 4 or 5 sets there next to the road. and the first set closest to the road is not in use. i was being stupid in my 323i and driving too fast with the traction control off but apparently theres a lot of people that crash there cuz the tow truck driver that picked me up told me this isnt the first time. |

If this is an issue with poor road design I'm surprised they haven't been sued multiple times. We had a similar design issue with a major road near my house where the county had left the road that way expecting an intersecting road to be built and a light to be set up. When that got cancelled they had to redo the whole road to elimiate the 90' turn.

Still, if there's precedent for the turn being unsafe or unclearly marked, you can bet that a corporation with enough $$ would be the ones to sue over it.

I wrecked a brand new F150 work truck about a month ago. The damn thing had 650 miles on it when I left the office. It was only about $1k in damage and happened during a bad snow storm, but it will likely be years before they stop giving me shit for it. Currently anything that goes wrong with our fleet is automatically my fault. On the upside, they're letting me use my own car a little more often now. |

The road is clearly marked, it has the little arrows pointing and I believe there's a sign that says sharp right or 20mph turn or something. It's a full 90° turn right after a long straight road... there will be people who misjudge... often.
