I truly hope that this incident does not cost you too much pain - but it should cost you some! You should be very thankful that some kid on a bike didn't come darting out onto the road, etc. I'm guessing that speed limit (while probably a conservative number) is there for a reason.
The ticket would have been $470 plus some $150/year for 3 years for some stupid NY DRI tax. Total = $920 plus 8 points on the license.

Got a lawyer, the guy didn't even care about the infraction. He said that he just shows up in court and the judge and cop just deal with him, they don't want to waste 1/2 hour with him doing the cop cross-examination, etc....

I spent $400 for the lawyer ( flat fee ). He reduced the fine to $120 and less than 3 points ( under 15mph over the limit ) so that the insurance won't kill me. That would be the biggest killer. Going 50mph over the limit could double or triple your insurance.

CZ

p.s. Also, I concur with the poster above. Speeding on residential roads is plain dumb. I hope that's not where you were speeding. All my speeding infractions have happened on interstate highways where your margin of error is much larger ( and no little kids on bikes ).

I'm with LEDZEP. Sounds unlikely you'd have a hope in hell of stopping or avoiding an unexpected situation. I think you should own up to the full 110 to both the courts and your insurance company. Take responsibility for your actions, man.

The ticket is for 85 mph. It’s not a ticket for "He might have been doing 110 or it might have been 85."

It’s either

Guilty of going 85 mph
Or
Not guilty of going 85 mph

Disclosure: I'm not a lawyer

Affirmative defenses don't work in most states traffic courts.
I.E.: The officer couldn’t have tagged me at 85 since I was doing 110. This will not fly in most states.

A lawyer is your best option as he can help reduce the sentence. A smaller fine, shorter suspension, whatever the case may be is probably worth the few hundred you pay the lawyer. Very few people win in traffic court without a lawyer. And it doesn’t sound like you have a case that can be won - just reduced.

Be thankful you don’t live in a state where a certain speed over the limit automatically makes it a felony speeding charge. In those states you would have lost your license on the spot and went to jail for the night - maybe longer.

Get a lawyer and don't take advice from a newsgroup. Too many people on these groups think they are lawyers because they watched an episode of Law and Order. Who knows, you could be taking legal advice from a 16 year old over the internet pretending to be an expert. I mean no disrespect to those posting here, but I dont see anyone willing to post their legal credentials along with the advice. Probably because as a lawyer you wouldn't give out free advice

Every situation has its unique circumstances. Even if someone has been through it before it does not mean you will get the same treatment. I wouldn’t risk it. I'd get a lawyer.

I agree, take responsibility for your actions and slow down. But if you can fight it do so.

How do you know you're not endangering others? Im sure the area you were in is probably a less travelled road, but if you were on it, how can you say for sure that no one else was on it? I'm not calling you a liar or anything, but you never know for sure, thats why there are limits. They are there to take in worse case scenario's for the possible road conditions. If you can reduce the fine and sentence somehow, by all means do it. Everyone makes mistakes and can learn from them. But please do not say you weren't putting anyone in danger, because 50mph the speed limit is WAY over (and thats just at what he clocked you at).

Be VERy polite and nice when cops pull you over. I walked away from a serious situation when I still had my GTi VR6.
One day after I installed the Limited Slip Diff and coilovers, I was trying it out near my living area. I made the rear end lose on purpose, and drift out the corner. While I was drifting, I saw a cop was waiting to take left at one stop sign, and knew I was in big trouble. I pull over immediately without she turn on the lights; any way, she pull behind me right the way. Here is the conversation.... Me, "Sorry, officer. I was being stupid, and here is my license, insurance policy, and registration." Cop, "You know that you are being stupid. Why did you do that?" Me, "Officer, I just installed new suspension and was trying to drive around to see if everything was ok, but lost control in the corner." Cop, "Lost control? I thought you were keeping the car in the perfect line." Me, ".... I really lost control." She went back to her car, and took more than 15 minutes to check my record. And I was thinking she would arrest me. She walk back to my door, and return me all the documents said, "You are a very lucky man. Since you are being polite and nice with no records on file. I am going to let you go this time. But if I caught you again driving like this on the street, I will suspend your license." I walked away.

Remember to be polite.

errr i remember getting a ticket in virginia once, i actually went 29 over and i got reckless driving ticket, i know that once you go 30 over the speed limit its considered something like endangerment or something where your car can be used against you as a weapon, I had a friend that went 30 over in virginia and actually had to go to jail for a day or so, so your damn lucky

I'm sure most of us has exceeded the speed limit by 10 MPH and I admit I drive over 55 or 65 on clear highways at least 95% of the time.

The quesiton that was originally posed was asking for advice on what to do.

I've been in traffic court 2 times. The first time, I tried to fight the ticket - claimed "not guilty" and the judge stuck it to me. I ended up paying the full amount of the ticket, took full points, and paid an extra court/processing fee.

The second time, I was meek, claimed guilty as charged, but pleaded for a reduced penalty. I ended up paying the full amount of the ticket, but my insurance and license penalty points were reduced significantly. This worked out much better in the long run.

My adivise is to get a lawyer to help you reduce the penalty. I don't think we're advising speedy to claim that he wasn't speeding because even in the open forum, he admitted that he's guilty of worse.

I got nailed driving from RI to NYC in CT (which prompted me to pick up an Escort X50) and was pegged for 84 in a 65. $280. I was going to fight it, but what could I say? 19 over is undeniable.

I would be pretty worried if I were you, but 110 in a 45...the rule is never twice the speed limit...usually you get your license taken at that point.

I would get a lawyer and an X50!

This is the reason to fight it.
It's a game, and if you have one ticket, they find it easier to give you more tickets.
You have a quick car, and will spend more time over the limit. Try to keep the liscence clean as long as possible.
The towns are in it for the cash. Pay a fine, pay a lawyer, and KEEP THE POINTS off of your liscence.
