Yes, your car was thowing a rich code in one bank before. That was the beginning of your sensor failing, not a tune issue and not caused by the tune-- the ecu CAN'T be tuned to run richer in one bank than the other.
I'd read in several threads that they shut both off. That is also why I was confused & why I asked the question. After communicating with Karl from Active he answered my question.

I'm referring to the data logged not the code thrown from the failing 02.

I am done wasting time with them, as stated in earlier posts. I am choosing to move on. I made it known to them that I was not satisfied with their product/service. When asking for a refund they denied., stating my hardware issue was not their tunes fault, even though the data logged suggested it's been running rich as did several other characteristics the motor displayed.

If they change their mind I will update the thread, until then I see nothing more to discuss.

And MarkkyyMan, I've shown you all of the data of my car working flawlessly for well over a year now. And I'm hardly the only one running Evolve+SS+3stage. No one here is judging you, just trying to help on a topic you seem a bit new to.

Hell, you know its a bad sign when even Axiom thinks you should give Evolve a chance with fresh O2s.

After a suggestion from a friend I decided to flash the car back to the stock DME calibrations. Since then I have drove 91 miles. These are the codes I have so far.

When did I say I didn't have a hardware issue? Are you even reading previous posts?
Edit: I stated I had hardware issues back on page 6.

Not quite sure what you're going for in all of this Obioban. Hoping in on the last two/three pages of this thread as it's concluding & acting like you know exactly what has been going on all along isn't serving you so well. Much of the comments you have made have been answered in previous pages & it would benefit you to read them before trying to discredit the situation. We know you have sunk thousands of dollars in this company and will defend them to the end of the earth, so if you are out to prove that please take it elsewhere.

I think you have the cause and effect backwards-- I have and continue to purchase evolve products because I think they're the best BMW tuner out there. Previously my cars have had tunes by Conforti, VAC, ESS, and AA. Over time I have moved all of them to evolve hardware and software because it's consistently the best.

I'm posting in here because I don't think their reputation should be damaged by a customer that won't (or can't) understand the issue his car is having.

My earlier statements on their CSL airbox & Exhausts containing valves was not to take anything away from those hardware pieces. I'm sure they work & function fine. My apologies to Salman & Evolve if that offended you in anyway, was not my intention.
