From what I've read so far, your lawyer is the only one who has declared the car a lemon. What you need is for BMW to declare it because, according to what I've read, the car must be in for the same issue 3 times and I'm not sure the light is enough to qualify. I think you'd need the HPFP to fail 3 times to really qualify as there is really no solution and it's a pretty major problem.

I believe its 3 times for the same issue OR 30 days or more off the road. Not sure what time frame the 30 days needs to occur in, maybe a calendar year? But I'm guessing.

Lemon laws vary from state to state. Consult an licensed attorney for advice pertaining to the laws in your state.

I believe that you are among the first, but not the last, to lemon-law their 135i. From what I see on the forums, many are either at or near the point where their car can be lemon-lawed. From this month's Roundel it appears BMW's response to the problem will be a twin-scroll single turbo engine and to h*** with those who have the N54. Maybe when enough cars are lemon-lawed BMW will fix the problem instead of bandaiding it.

Nobody seems to notice this. But I have had issues with my car that nobody else has had. AKA my top completly failing. What I mean by the dashboard thing is that back in November the bolts holding my instrument cluster to the car fell off, cause a horendous rattle. Its in now for a completly different rattle that is inside of the dashboard behind the glovebox and it has yet to be diagnosed.

The only engine troubles im having are HPFP related, but it hasnt failed. If this was 2005 I would jump on that M3 bandwagon however, but I have driven an E92 M3 and the car is simply too large for my liking.


And from what I understand its 30 days in shop with documented warrenty repairs within the first 18 months of ownership in NY.

My father talked to the lawyer as I am still at school right now.

I am very confused by this comment. Driving a Zed with top down is no different than driving my 135i topless. We all bake under the same sun. Im worried about skin damage because I am a true convertible guy. If I have a top it will be down, unless its raining. I didnt even let snow deter me last February...but I did get massively sunburned on several occasions.

Topless at 45 with snow falling around is a magical experience.

(the Z4 comment didn't make any sense to me either, but maybe he didn't realize you meant your skin damage - I always keep sunblock in the door pocket)

Thats really true. I do love my 1er and as ive already said if I do get it replaced it would be with a new 135i. If im talking 2010 here for a replacement maybe I should consider a SuperSport. See if I can swing a deal on it.
